Hi Wind23 or everyone who may help me out?
I tried to call CIC for an uci number but I quickly found out that I can't call them from overseas. Is there a number I can contact CIC from outside Canada. I'm desperate to link my status so I can follow the process without depending totally on my representative. Thanks again for any help.

Hi claudi12,
If you have a representative you can't link your application :( I guess you just have to pester your representative for information ::)

Hi guys, Plz help as I am in a huge mess :'( :'( :'( :'( :'( :'( :'( :'( :'( :'( :'( :'(

I am a Canadian citizen and living in UAE with my husband (Pakistani National and he works in UAE on work permit) and we have a daughter together who is 1 year old now. We married in Feb, 2014 and I was a permanent resident at that time. the wedding was planned in second week of February and I went to Pakistan to get married. However, luckily or unluckily I received a letter from Immigration and I was called to take the citizenship oath. We didn't cancel the wedding and we decided to do the Nikkah by proxy where my brother signed the nikkah Nama. I had left for 2 weeks to Canada and got my Canadian passport and documents and returned to Pakistan after 2 weeks. I had my rukhsati done in 3rd week of Feb, 2014. We lived together and started our married life.

I was finally able to complete the application for my husband's sponsorship and I sent it to Mississauga and they received it on 29th August, 2016. Afterwards I found this forum and started reading etc for support. I was nervous so I started checking CIC website for eligibility criteria etc and came across a question in Help centre that I never saw before. Its the following:

"Does CIC recognize marriages conducted by proxy, telephone, internet and fax?

No. As of June 10, 2015, CIC no longer recognizes marriages conducted abroad by proxy, telephone, fax, Internet or other similar forms of marriage where one or both parties are not physically present at the ceremony.
Applications received before June 10, 2015 are not subject to the new regulations.
An exception has been made for members of the Canadian Armed Forces who are unable to be physically present at their marriage ceremony due to travel restrictions related to their service. This applies to cases where the marriage took place outside of Canada and was registered in a foreign country where marriage by proxy is legal."

My heart has dropped. I got married in Pakistan and according to Pakistani laws, my marriage is recognized and absolutely legal and we now have a daughter together. I am freaking out. Will my application be denied?????? Plz comment if somebody has any knowledge about it.

Thank You

One of the solution may be for you to withdraw the current application and reapply as common law.

Thank You for replying.

But I am married. I will not have any common law relationship declaration or government documents to support it. Common Law or any sort of unmarried relationship are banned in Pakistani Laws. CIC do say that they will not recognize such a relationship that is not recognized by the laws of the country where we marry.

I am soooooo losing my mind right now :'(

In CIC's eye you are not marry and you are a Canadian therefor common law should be perfectly legal. You do not need any government document to support a common law relationship, you just need to declare it. CIC's Operation Bulletin 613, subsection 3.8.1 states that you can amend the application by submit an IMM 5409. Here is a link to the bulletin http://www.cic.gc.ca/english/resources/manuals/bulletins/2015/ob613.asp

You r a life saver!!!! Thank You sooooooooooooo very much

I read the bulletin. Now should I just fill out the common law relationship forms and send them out to Mississauga ASAP
OR
Should I wait for CIC to reply to me with a refusal and then send a different application package? As I don't have any application number right now and all original police certificates etc were part of my original application, where do I stand at this point???

You can try sending the IMM 5409 by using the CIC Web form http://www.cic.gc.ca/english/contacts/web-form.asp

Thanks, let me know if you got DM on Sponsor side after a week or so, because I am observing the DM that most applicant received in sponsor side from january to July 2016 applicant. Im trying to convince myself that it was for sponsor side and wont affect the PR side. Or it could be a sign to, that once DM for Sponsor, maybe the PR side has been apporved in elligibility or anything.

I just checked our application online now and it says "Decision Made" on the sponsor's side.

You cannot apply as common law its going to complicate your case because in pakistan it is not common to have any relation before marriage and if you do so they are going to definitely put in the interview queue.
