hi i was just married in Uruguay, i am a Canadian citizen and i want to bring my wife to Canada. I have a Assault causing bodily harm conviction, the Incident happend 12 years ago but i got convicted in 2008 and was given probation for a year, i have not had any other convictions since this incident. I understand in order to qualify you must have finished your sentence five years prior to sponsoring. Does anyone know if there is any leway in this? is it case by case? has anyone gone through anything similar? I apreciate any input

The rule you're talking about applies to the person being sponsored. Different rules apply to the sponsor (you). Who did you assault? This is pretty important. Was it a family member or a former spouse / partner / someone you were dating?

How is a 5 vs 1 not considered self defense?

Did it have to do with you carrying a bat in the first place perhaps?

The guy is just asking a question. There's no need to give him the 3rd degree.

Well, you can't be vague if you want a useful answer.

He doesn't mention the exact charges, and in his case the nature of the conviction can be important.

It's an anonymous platform, so you might as well be honest. It might get you some legit help.

He states: I was just defending myself with a bat against 5 guys, but the damn judge convicts everybody.
Sorry, but that doesn't sound legit and will get him shitty advice.

sammy, I have a similar issue. I got in a fight (verbal then physical) and ended up with assault causing bodily harm. I was given a suspended sentence which is just a simple probation and i am currently a few months into it right now. From what i've learned as long as the offence couldn't of had a maximum 10year sentence then you should be alright, anyways i've chosen to use a immigration consultant just to make sure he looks over it all and it is worded properly when i send the app in.

Lol you are funny. I hope things work out for you. We all do things we aren't proud of but everybody make changes and acknowledge their mistakes.
Now did you bleach your skin too? :p

You should probably consult an immigration lawyer. Even after five years, you would have to prepare some justifications.

Good luck!
