Apply for LMO

Dear all,

I am so worry about my situation now.
I need help please.
The situation is I have been working at my company for 6 months but the employer doesnt want to apply LMO for me. My work permit gonna be expired in 4 months. I have been looking around to find an employer to apply LMO for me. Other sides, my cousin own a business and if she want apply LMO for me, does she need to post an add on a website for the proof. And can she apply LMO while I still working at my company now?
I am working under Post Graduate Work permit.

applying for LMO is not mandatory to file for WP. however there may be rejection if there is no LMO. Yes while your cousin applies for LMO u can continue working in your current employer, but not more than the validity.

Instead you can apply for Open WP, for which you dont need an lmo

Why do you think the OP qualifies to apply for an open work permit?

OP - Yes, your cousing must advertise the job. For the LMO to be approved, your cousin must prove that a Canadian couldn't be hired for the position.

I finished one college in Windsor, Ontario.
I got Post Graduate work permit for 15months ( Jun 2012 - october 2013) . BUt i wasnt able to find a job until Dec 2012. so now my employer doesnt want apply LMO for me, and my cousin will do it. But the question is does she need to post an job add on website when she doesn LMO ( NOT inluding my name on it)? cause on CIC webiste said that worker who works under PGWP doesnt need to provide Advertising efforts when apply LMO. In my case, I am not her employee yet so does she need to prove that?

My cousin owning a Pawn Shop. so what is the best job title she should put on LMO? SO that it can help me apply for PR.

Because I started to work in December 2012. My work permit will expired in Octber 27, 2013. I will be sort of 2 months. thats the reason i really hope to get LMO so that i can extend my work permit and work up to 12months and apply for PR.

Please help!!

If you start working for your cousin now (before your PGWP expires), then she won't have to advertise the roll to obtain an approved LMO.

she will training but she may not hire me right away. and on Cic website said the LMO should be apply approriate 4 months before the work permit expires. and my work permit will be expires in about 4 months October 27. so if i work for her, will it ok to apply in 2 moths before expiration date? and is it risky to do that? im just so worry in case LMO will be refuse.

- As long as your PGWP is still valid, your current or future employer does not need to demonstrate recruitment efforts. Your cousin could (should) apply for the LMO before hiring you. On the application, for the question regarding "intent to permanent employment" she would have to answer "yes," and where it asks about recruitment efforts, explain that you are being hired while on the PGWP. She should include a photocopy of your PGWP.

- It is recommended that you apply for the new work permit for months before the expiry of the old one. However, as long as you apply for the new work permit BEFORE the old one expires, the application will be vaild. You will be on "implied status" if your old permit expires while the new one is in processing - this means that you can continue working under the same terms as the old work permit. During this time, you cannot leave Canada or you will lose implied status.

- However, to succeed with the LMO, the job must be a skilled NOC. If you are simply a store clerk, that will not qualify. And if you don't have the education/experience to be hired as a supervisor/manager, the LMO is unlikely to be approved.

I have been persuade my employer to apply for LMO fpr a month but there is some reason he doesnt want so i cant do anything

What about if my cousin put the job title as " Retail Sale Supervisor"? it fall under Skill Type B. I had sale experience back home, but since I have been in Canada, I had work expirience for Administrative assistant/ Translator for 6 months. I also studied 1 year at a college in Windsor, On.

How likely i will receive positive LMO?

AND another question is " if my cousin apply LMO before hiring me, does she have to demonstrate my name on the LMO?"
