Hi Sachin,

Sorry to hear that yours app was sent back, I too didnt had my birth certificate (BC) as I was born at home. My father then applied a pettion in court to direct the municpal coporation to issue a birth certificate, the entire process took about eight months. Once I got the BC I applied for Canada.
Please clarify if you has attched a sworn affidavit stating that you dont have birth certificate and your date of birth and place of birth is as mentioned in the passport.
I hope you are from India and I suggest you file a petition in the court (seek assistance of a good lawyer) for issue of the birth certificate and meanwhile create a new sworn affidavit stating that you have approached the court for issueing the BC ( attach the court reciept for proof) and you and your spouse will send the BC to VO at a later stage with medical report (or even earlier) and resend the application at the earliest.

I hope you are from a low risk NOC category which is not yet filled, if you are from high risk NOC like 1112 then probably it would be filled, anyhow you can take your chance and send the app, if the NOC is filled then they would resend the app along with the processing fee.

Seniors , Please put in your thought and guidance , and happily correct me if I'm wrong

Yesterday was a very sad day for me as I received my application pack returned for not submitting my date of birth certificate. I am a July applicant. Can someone tell me the solution as I do not have this certificate for myself and my spouse. They are not considering DOB mentioned in passport and 10th Certificate. I was born at home and birth was not registered with Muncipal Corporation office

Would appreciate if someone can help me in drafting the explanation for the same to cio

Thanks for the help

May I add that there are people still waiting for their applications to be processed from all the way back to 2003, that have not heard anything in years! We are all trying to immigrate to another country and they are being extremely kind to allow us in.

Regarding our group, post June 26, they have updated us only four months into the process as to how things are looking. Unfortunately though this does not seem to be enough for some who would like a one page summary with their morning paper and coffee every day. In my opinion they are doing the best they can and would be the first to show us the door if we are displeased... because outside that door there are literally millions of people glad to take our place.

This phone number is the only way for some of us to resolve emergency matters, let's not take actions which would lead to it being removed. Patience is certainly a virtue in this case...

All in my opinion,
Cam

I have a same view with you Cam, we should appreciate Canada 's considerate door opening for immigrants from other countries. There are millions of hopeful immigrants who those have been waiting long already. In comparison with them, deem that ours processing would be better speedy.

Hi Sachin,

Very sorry to hear about your application coming back, but you are lucky to have it safe back home unlike others whose applications are lost in transit. Now you have 2 options, to get a BC ready and then apply or try your luck by applying with a sworn affidavit along with the below mail from CHC - New Delhi, quoting you can provide passport, school certificate, or a ration card instead of a BC and it's acceptable in India and ND VO. Anil and a couple of others have applied like this and we are confident that it will be accepted as ND VO has indicated the same in their email. May be you can PM Anil and get a copy of that email from ND VO.

Good luck and please submit your application ASAP :) :)

2. Original transcripts which you are providing in order to obtain points for education will NOT be returned to you. Any original degrees or other documents will be returned to you at time of decision

I guess that's the best thing to do now, given the confusions about the cap.

Good Luck

If they are stockpiling all applications - rejected and passed eligibility review - until they reached their cap (and it seems they are getting less applications than they anticipated which is why they seem to have extended it for 33 weeks) then this is both dishonest and unfair. They are introducing arbitary delays that they have no reason to introduce. As Canady says, this leaves candidates no possibility to reapply and fix whatever the application failed for, if it is fixable.

But SOOO many people have reported 33 weeks that the number must have some significance, maybe it's a standard answer from CIC to fob people off and stop them phoning.

Also I agree the number of applications which have been lost seems staggering. 4 or 5 on this thread alone so far, and I think our thread represents what 5% at the most of the total post-June-26 applicants worldwide?

Wayne.

I think 33 weeks is the MAXIMUM time by which we should receive some communication. Though it was 10 weeks before, but many people back then got responses within 6 weeks of sending app -likewise, it can be earlier than the maximum 33 weeks limit for us as well.

And about the theory that we might straight hear from VO the first time, I disagree since according to OP6 (section 7.2) -we should hear from CIO about acceptance/rejection after eligibility review (before they send the docs to VO or back to applicants).

About the theory that they are stockpiling applications for them to reach 20,000 -I somehow feel the 20K cap will never be reached. This is because there will be more than 1000 apps for categories like 1122 (only 1000 being counted) but some categories will never reach 1000 (as the trend at CIC website suggestes). So waiting to reach 20,000 doesnt seem much possible.

I read it somewhere that one of the earlu June applicant was told that CIO have until Jan 19, 2011 to send AORs for pre-June. May be this is also a MAXIMUM timeframe for pre-June people and they will clear them much before. After that, I guess we will have our turn Inshallah -may be in Nov, Dec or Jan.

I wish it happens much earlier!

My application also was returned. The reason was incomplete application. They sent it on 11th of August and I received it after 1.5 month. On 22th of September.
So big delay in receiving is possible.

hi
i am new to this forum and i sent my application on 23 sep NOC being 1122. i didnt check with the bank if my BD has been encashed yet. going to do it today. the thing is i didnt include birth certificate as i thought passport and ssc certificate would be sufficient for that purpose. but ive seen here that files are being returned if they dont include birth certificates. is that true with all the cases? and is it possible to get one and send it before they return my application? i am totally confused now....

Mars Volta, sorry to hear that, can you please shed some light, as to which aspect, it was incomplete, any thing they mentioned in the letter, or you yourself realised is missing.

Though you file is returned and the time wasted cannot be brought back, if you share, it will help many other to avoid the same mistake.

No, none reported yet. If we have no AORs or rejections after encashment within the next couple of weeks, this would support the little theory that they are going to stockpile them all, and then send all AORs and rejections at the same time once they hit 20,000 - meaning anyone who is rejected has no chance at all to reapply this year.

If this is true, it is pretty sucky :(

What if they dont hit the total 20K cap by 33 weeks (some NOcs will possibly not reach 1000 by end of June 2011)? They will pretty soon reach 1000 for NOCs like 1122 (as CIC website trend suggests), but 20K total seems far. How long are they going to suspend the AORs?

@ wayne,
Thanks for your response and concern.
Hmm that would be really sucky. But I was wondering how could be post june is so called "fast tract" if thats not fast at all. :'(. or may be we need to be more patient?
Another point is that some of the post june applications are returned back very quickly if there is any minor mistakes found by CIC. Therefore , I am not sure why they will encash + stockpile and then return some of the applications!!
Again confused confused and confused. :-\...
Anyway we are not sure about next year at all. Everythign may change in one year as the CIC has ever changing policy to earn as much as possible from all sorts of applicants.
It sucks.

Thanks a lot buddy for your response.
