Dear all,

My case has been disapproved... :-[
CIC, London send me a letter saying the following:
Dear Applicant,
Thank you for your application for permanent residence in Canada as a Federal Skilled Worker. I
have now completed the assessment of your application and have determined that you are not
eligible for processing in this category for the reason(s) noted below.
The Minister of Citizenship and Immigration issued instructions which were published in the Canada
Gazette on November 28, 2008. These instructions specify that only applicants who have Arranged
Employment Offers, who are legally residing in Canada and have been there for at least one year as
Temporary Foreign Workers or International Students, or who have work experience in certain listed
occupations are eligible to be processed in the Federal Skilled Worker class.
We have assessed your declared occupations against the list of occupations identified by the Minister
of Citizenship and Immigration and published in the Canada Gazette on November 28, 2008.
You have indicated that you have work experience in (an) occupation(s) with the following NOC
(National Occupational Classification) code(s): 4131 - Vocational Instructors
Although the NOC code(s) correspond(s) to the occupations specified in the Instructions, the main
duties that you listed do not indicate that you performed all of the essential duties and a substantial
number of the main duties, as set out in the occupational descriptions of the NOC. I am
therefore not satisfied that you are a Vocational Instructor - 4131.
Since you did not provide satisfactory evidence that you have work experiencin any of the listed
occupations, you do not meet the requirements of the Ministerial Instructions and your application is
not eligible for processing.

I would like to know from all of you if there's any other way to achieve it. Please advice.
I sincerely hope that no one faces it like me. Wish you all the best.

In the experience letter it was clearly mentioned that I was employed by my previous company to make their employees computer literate and DTP experts.
I thought it was enough for an experience for this category. My experience was from 1995 to 2001. So only 3 years of my experience was counted within recent 10 years.

Hope its clear now.

"You are currently working in Canada on a work permit. Your work permit is valid when you apply for a permanent resident visa and;
Your employer has made an offer to give you a permanent job if your application is successful.
Note: Your work permit must be valid at the time your permanent resident visa is issued."(www.cic.gc.ca/english/information/applications/guides/EG72.asp#factors5

Help pls,

My spouse is currently in canada now on temporary work permit, she got their 1/10/2010 and she is currently waiting for "AOR" from "CIC",she submited application for parmanet residence 08/06/10 and the application was received in sydney on 15/06/10.The work permit just came in miraculously as she have work on it since early 2009.

My query is this,we intend to use this work permit as "arrange employment".she is still expecting"AOR" from "cic" sydney but with a fellow member of forum quoting the 1st quote stated above in is rejection letter from is visa office(London) would it still be good for us to go on as we have plan? The second quote i got from the guide explain notting is bad if she present the work permit for "arrange employment" since she is presently in canada.

please senior your contribution is highly needed.

I don't find any mistake in my reference letter but unfortunately without verification they rejected my application. So now a days they are refusing application without any reasonable cause.

Dear Samindia0,

exactly the same reason my case was refused recently. My NOC was 1111 (Auditors & Accountants). My refused letter was as like as you nothing changed only copy paste. they are not satisfied with my job resp. that i mentioned in my Ref. letter. to Singapore.
What they are working with the genuine applicant like me i don't know...
I know many people in my country very personally that their papers & job exp. not genuine but the got approved due to only good presentation their Ref. Letter.

This is INJUSTICE i said.

The visa off. should Verify every applicants physically over phone or the way they like best... but shouldn't rely only upon the well presented docs.
Many of us in this forum don't have any consultant due to lack of financial crisis....also.

Still my status shows that VISA OFF. ELIGIBILITY REVIEW COMPLETED for the last Four Months....
Also i didnt get my fees refund as the visa off. indicated that i will get my money back within next
several months.....
Please keep patience and believe in GOD.... he is the only One who can help the GOOD PEOPLE..
