I agree Canada might have a point to consider "anchor babies/birth tourism" as US but there is no mention about it on the CIC website.

Applicants should be aware of such policy before they apply so they don't go through the process only to be told later that their application was rejected because they did not earn points for their baby who were born here and are Canadian Citizen or PR holders. And I am sure the Parents of the babies born here do not have an ILLEGAL STATUS (or else they would be barred from applying in the first place).

Did you hear something from someone or read it on the website....it would be really good to know about the source of this info.

They clearly removed the adaptability points in the new regulations effective this May. So there is no need to such abstruse action. Officers are human and they may make mistake like us.

Of course they don't have illegal status. I'm not saying anyone here have that, we are all students here. I've actually been looking for information about that and see if there is any thing in the regulations about giving points for baby or not. It was always the forums impression that that was the case, but given the recent doubts I came to realize I never seen an official statement, as i don't have kids myself and totally skipped anything related to relatives in canada.

it's clearly said under adaptability points:
"Relatives in Canada
You, or your accompanying spouse or common-law partner, have a relative (parent, grandparent, child, grandchild, child of a parent, sibling, child of a grandparent, aunt or uncle, or grandchild of a parent, niece or nephew) who is residing in Canada and is a Canadian citizen or permanent resident."...
So they have no reason to deny these 5 points provided you give enough documentation to show the child is yours ;D ;D

that's new info to me!...thanks for posting ;)...but i guess it comes into effect this may..so they don't have the right to deny it for all of us who applied earlier ;)

Yes, that is indeed the case. I was puzzled by other saying that they were not getting the points. This is a clear winnable appeal case.

You're right. If you have not credited the point, just appeal it. It's clear.

I know a different case which the guy was not aware of that and at interview (for Quebec) officer mentioned it and gave them the points.

I am surprised that this information is not posted on the main CIC website which would mislead applicants.

@ TyrusX..... I hope you did not misunderstand my reference to the "illegal status" in my post. I was just supporting the fact that CIC cannot reject the points for a valid claim since all you guys DO have a legal status.

CIC modified the Adaptability status on 2012-09-07....so anybody who has applied prior to this date can still claim points for children not 18yrs.

No problems dude, I'm very surprise by this change in the regulation as well. Given those post from Jason kenney I thought I may have missed some new change with respect to that and we actually found something very important here. However the regulation still seem to be a bit "to be determined" instead of a concrete thing. Let's keep ourselves informed with respect to this.

My application reached CIC on December 7, 2012. I wonder if there are other December applicants and I wonder if they have heard anything from CIC so far?

I haven't heard anything from them till now.

keep checking ur credit card, it might be encashed this week or the next week, also keep checking ur status online using ur client ID
