ejamal and jessiezz got their PER on the 24th (Feb), and their medicals on the 25th (May), so yours could probably come by the 8th if we are to follow similar patterns. But then again, other people with the same or earlier PER dates as yours (meteor2012, Dani1982, AF___, famou12, 30pixie) have not reported. Hopefully any of them would be kind of enough to update us if they do get anything :)

1) Hi, I was wondering if there is any news from the ones who APPEALED for their applications about the 5 adaptability points on over 2 years of PhD studies in Canada? I did the appeal but never got any answers.

2) In case we need to re-apply, could anyone who can tell me WHETHER the 5 ADAPTABILITY POINTS for over 2 years of PhD studies in Canada can be AWARDED right now??

Hi Aaron2012, how long ago did you appeal, and was your NER based on not having enough points? Several applicants appealed for these 5 adaptability points, and succeeded, but there are also others who have not heard anything yet, so we're not completely sure what's going on. If anybody who has successfully appealed can fill us in (such as the format for the appeal letter, where to fax the letter, etc), that would be appreciated.

Hi, asbereth, thanks a lot for your prompt answer. I got my NER exactly because of the failure to award that 5 adaptability points as other applicants. They said I did not COMPLETE my program even I have been studied for over 3 years of my PhD.

I appealed at the end of last month. We appreciate a lot who can share any news about the status of the application having the same situation. Or, any evidence that the VOs are now awarding 5 adaptability points for our full-time PhD studies.

You need to be patient :). I appealed at 20th of May and I just got the news. I got my PER. So please be patient. All is good.

Hi sohappyboy, so I take it you got your PER today, and you appealed for reconsideration of the 5 adaptability previous study points? Congratulations :D Anyway, have you completed any post-secondary program of two years length in Canada at all, or were the 5 points based purely on the 2 years of (not-completed yet) PhD? Can you share a bit more about you did (such as, did you appeal through fax, what you wrote, etc)? I think this would be helpful to a lot of people under similar circumstances :)

Hi asbereth,
I am a PhD student studying in Canada. I have already finished my 2 years of PhD programm. I sent my application On last decemeber, however, I got my NER in March because of 0 adaptibality point. As I mentioned, I appealed and it worked. I sent an email to " CIO-Sydney-Search-Enquiry@cic.gc.ca " and asked for reassesment of my application and it worked.

The OP of that thread also sent an email inquiry to the CIO, but it took forever for them to reply, so he decided to send it by fax. So it's probably something that Aaron2012 may consider as well?

Thanks so much for the information from sohappyboy and asbereth. I got my NER in March too. :( I did send the email and regular mail, but I didn't send fax. I checked the fax number from that link, and I found it cannot be identified and it could not be in Sydney from the region code.

I think 902 is the area code for Nova Scotia? Were you talking about this number, +1(902) 270-3561?

Yes, this is the number I am talking about. I just searched this number and I did find some other numbers (but not the number 902-270-3561) for address change last year. CIO changed the number several times and this year they seemed to have removed that fax service; instead they provide a online address change service. Therefore, I think that number may not work right now.

Aaron2012, the appeal may take about 1 month or so to be processed. I guess I was lucky to have received my PER just within 4 days after appealing. But if you don't receive the email concerning your case, write another letter in which state that you believe there was a mistake in the assessment of your application and quote IMM7000 (Factor 6.B) and OP6B (Chapter 9.15.b) in pursuant to R83:

B. Previous study in Canada:
• You or your accompanying spouse or common-law partner studied at a
post-secondary institution in Canada for at least two years on a full-time basis
.
This must have been done after the age of 17 and with a valid study permit.

b) Previous study in Canada:
• Award five points if the applicant or accompanying spouse or common- law
partner completed a program of full-time study of at least two years’ duration
at a post-secondary institution in Canada, if this occurred after the age of
seventeen and with valid study permits.
(The person is not required to have obtained an educational credential for these
two years of study in Canada to earn the points, but simply to have completed at
least two years of study
.)

And then ask to reconsider your application for further review. Fax this letter to (902) 270-8530. I have no idea what number is this, except that it works. On the cover page, write your name and application number. You will get a regular email from the same address your NER came from, saying that your application has been forwarded to a visa office for further processing.

And keep fighting. We are eligible for those 5 adaptability points.
