Is it possible to get an Annulment or do I have to wait to get a Divorce?Husband here only 2 months gone to the USA claimed political asylum He is Cuban Together almost 11 years met in 2003 :'( >:( :-X :-\
 
I don't think you qualify for an annulment unfortunately. I think you should be looking to divorce him. Sorry you're going through this - you should report him to CIC/CBSA asap.
 
That really sucks. I remember you very well Double Rainbow. You were always hopeful and excited about your husband coming over, even had an 11 year relationship, but it's unfortunate that after a short time here, he decides to leave you.

He's really stupid to be honest, choosing to claim asylum in US, which is bound to fail since he is a Canadian PR. Not to mention he would rather take a leap of faith on claiming asylum in US rather than remain in Canada as a legal PR.

Report him to CIC right away and at least revoke his PR. Sorry for you having to go through this.

Thankyou scylla I did report him ;) I found out post arrival that he had a baby born the same year we married. He also called the mother of the child many times from the house. I got the bill and saw many calls. I told him his child cannot come to Canada now as she was not entered on the sponsorship as you never told me or my Immigration Consultant anything. He then pulled a 360 on me. He was someone I did not know at all. Verbal abuse daily many times during the day and 3 different incidences of physical abuse. The physical was shortly before he left. Any excuse to get me angry to make him leave so he could use the excuse at the border to say my wife kicked me out blah blah blah. I myself drove him to the border to make sure he was actually leaving for the USA. I did not want him to stay here in Canada to take advantage of Canada or another Canadian. I don't want this for the USA either and contacted them also.His whole family,friends knew about this baby girl except me. I was close to his mother also or so I thought. I believe she and the rest of the family were in on it. He has a half sister in Miami where he said he did not have a good relationship with ever but yet he is living there along with her husband and children. Oh he also said his sister was single on the sponsorship app and she was married with 2 children One of the children is in university and the other working. I believe he is now looking for his next victim to get his mother out of Cuba. I never met his father as he did not again have a good relationship with him. I don't believe this either now. He is a compulsive liar. He will use anybody from any country to get his mother out now as he blew it with me and with Canada. There were many calls to and from Miami just before he left. I am sure his family told him to get out of Canada before he gets thrown in jail or sent back to Cuba. I thought I was safe after almost 11 years with him :o :'( >:( I hope he gets thrown in jail and the keys thrown away along with everyone who helped him through all. He is pure evil I have been recovering from chemo since March 2014 I started a maintenance plan in June 2014 of one of the chemo drugs to have once every 3 months for the next 2 years. To take advantage of a sick person like this Wow! I am trying to wrap my head around this still. Unbelievable. He had no compassion, no emotion, did not care about what he was doing to me at all. He is very selfish to the max. Not the person I knew in Cuba all these years. We always had alot of communication as hard as it was to have communication in that country. We went to church here even, all a lie. This really floors me as he used God. Poems of love and God to hook me I guess. To use God's word for personal gain is beyond my comprehension. He and his mom claim they are religious where crosses with crucifixes on gold chains around their necks. They are not in my books. They use God for gain Wow! Pretending to love when they don't. I worry for his next victim. Hopefully it won't happen again and that he is in jail very soon where he and his lying family and friends belong with the keys thrown away for many, many years. Un effin believable! :o ??? :'( >:(

Thankyou mikeymyke :'( and thankyou to remember me too. He has the right to claim Political Asylum in the USA as he is a Cuban national, even with a PR card :( I don't get it really. How can they claim this from a 1st world to another 1st world country? They can I was told by Canada and by the USA. I can see making it from Cuba to the shores of Miami, Florida to claim but from here to there??? Ah well maybe it is a good thing for me lol I got rid of him thankfully and gratefully instead of him lurking in Canada and probably to take more advantage here of Canada or another Canadian which I did not want to happen. I don't want this to happen there either and contacted the USA border services as well. I hope and pray he can no longer re enter Canada and if he tries that they will revoke his PR card. I tried to get that from him before he left but he would not give it up. He said it was his.

I see that they applied in july 2012 before the new law so I am wondering if reporting the end of their relationship would get his pr cancel?

It's not stupid at all from that perspective. He'll most likely have no issues becoming a legal resident of the US due to the "dry foot" law that's specific to Cubans.

Agreed. It will be a case of "he said she said". It won't be revoked. We can all hope he doesn't meet his residency obligation however.
 
Agreed... on that point. But what about the fact she has proof that he lied on his forms? Signed the papers stating no children when he obviously had one. Likely won't matter in the end.. but that is still one way she could proceed.

He, obviously, was very aware of this policy. He used her to get close to his family and have a better life in US. Sad story, especially after 11 years of relationship.
 
Wow, 11 years. If he had MoC on his mind from the beginning, then he was certainly patient.

I see that he was called for an interview? Was there anything that triggered the interview? I hear that if the case is straightforward then they may not call you for an interview. I could be wrong but wondering if there was something concerning to CIC.
 
He was called for an interview, then refused. They appealed and won.

I'm sorry to hear about this. :( I wish you all the best.
 
Unbelievable! I remember you Double Rainbow, going through chemo, etc and the appeal. So sorry you are going through this. On the plus side, he is in the US now and hopefully, he won't return to claim welfare.
Since you have proof of some misrepresentations he committed, it should hopefully make a stronger case for revocation of his PR status.
