easier to have reapplied
It depends. In our case no, it would take another 18 months as we also need an ARC. Also, the visa officer had a huge bias and did not take into account all the positive things we and my spouse were doing in trying to get back to Canada. I appealed to make these visa officers accountable for their actions.

I see. So the officer refused you based on his opinion lack of proof intent to return to Canada?

Yes and felt since my husband had no status in Canada at that time they wanted to hold over him for the rest of his life. He is not a criminal and has no criminal history. Even criminals in Canada are allowed to be rehabilitated. In addition, they were trying to dictate to me as Canadian citizenship what countries I should live in with my spouse. They can not legally do that. The member agreed and granted us the appeal and we won. They cannot keep Canadian citizenship separated from their spouse. The hearing was not even about the genuineness of the marriage as CIC already stated it was genuine. It should not have to come to appeal it. Anyways looking forward to this being over soon.

The link that I posted says : « Any physical Family Class appeal files being shipped to CPC-M by CBSA will continue to be received by the mailroom, but will not be opened or triaged for processing at this time. Remote processing may still occur on appeal files that had previous been triaged. However, any new files being receives, or those still in boxes in the office, will remain there until the provincial restrictions are lifted »

Hello!
I’m looking for some guidance on the appeal procedures. After my sponsor sent our notice of appeal last October (After refusal in September) we didn’t really look into the appeal process. Today my sponsor’s family member got a package with our file data, the amount of pages is insane! On the first page it was written “appeal division”. What is this? Was that sent to us to get prepared for the appeal hearing? We can’t really look it through because the sponsor is currently living with me outside of Canada. What’s going to happen next? As we decided that it’s probably more convenient for us to resubmit a new application I was wondering at which step we can cancel our request for the appeal and be able to have a refund?
Hi. After sending the appeal application did you guys receive Acknowledgement letter before receiving the package? Thanks

As I know, there was one appeal which was allowed in Aug 2020 and reopened at beginning of September. That file was sent to CPC-M as well and got PPR last month.
However, mine was approved in May 2020 but reopened on September and now still waiting for the medical request. What I can say, it was really depend on which VO deals with your case.

Mine also transferred to Missisauga Visa office as per CBSA.
Yes, mine transferred there in January 2021 so I might have a really long wait. I sent in a Web form weeks ago, got a response today asking for PA information even though I provided them with my application number. This is just a way to stall things even further. A bunch of idiots. I'm was very calm before but not I'm getting frustrated with the process.
