Did you ask if the interview is recorded? My lawyer said she was going to ask, but I never heard back from her yet. I really hope they recorded the interview.
I never asked the lawyer.

Hello all,

Finally, received Golden PPR email... But I got a question here... can anyone please help with ?

4. If not yet paid, Right of Permanent Residence Fee (RPRF) for you and your accompanying spouse (if applicable). We strongly encourage you to pay your fees online and provide a copy of the receipt. To pay your fees online, click here: https://eservices.cic.gc.ca/epay/welcome.do.

(I paid $ 1,040 including RPRF fee when submitted sponsorship 2017, in above request it didn't ask for a copy of receipt if it's paid. Just wondering if I can skip this as I couldn't find my receipts, I am assuming IRRC should keep my record, but I just don't like to wasting time..so PLEASE advise ...
Thank you all,

What are the reasons for rejection during background check? Is there a chance to appeal if your visa is refused due to background check?

Hello guys,

I have an appeal hearing with the ADR in 3 weeks and sort of really nervous, was hoping if anyone has won an appeal with them recently? the appeal is for my wife, our sponsorship was rejected on the basis of misrepresentation of a police clearance certificate, we didn't even know there was a problem with it until it was too late we have two kids together and was hoping we could be granted humanitarian relief. I have some supporting letter from my manager and a few family friends, if anyone could please let me know how things work with the ADR i would greatly appreciate it, thanks!

What misrepresentation with your pcc? And which visa office handled your sponsorship application? Can you copy paste your refusal letter ? Then seniors will answer for your question

Yes, it was regarding my spouse's pcc, the visa office that handled our application is Nairobi, Kenya.
Bellow is the attached refusal letter.

Dear Applicant,

I have now completed the assessment of your application and I have determined that you do not
qualify for the Family Class to Canada.

Subsection 40(1)(a) of the Immigration and Refugee Protection Act 2001 states that a foreign
national is inadmissible for misrepresentation for directly or indirectly misrepresenting or
withholding material facts relating to a relevant matter that induces or could induce an
error in the administration of this Act. Paragraph 40(2)(a) specifies that the foreign
national continues to be inadmissible for misrepresentation for a period of five years following,
in the case of a determination outside Canada, a final determination of inadmissibility under
subsection (1).

On 27 October 2017 in Nairobi, Kenya you misrepresented or withheld the following material facts:

- You submitted police certificate number 575588 dated 21 April 2017 which was confirmed by the
National Police Service to be fraudulent.

On 19 March 2018, we sent you a Procedural Fairness letter giving you the opportunity to respond to
our concerns. Your response did not allay these concerns.

I reached this determination because the National Police confirmed that the certificate
was fraudulent. The misrepresentation or withholding of this material fact induced or could have
induced errors in the administration of the Act because a visa could have been issued to you when
you had not demonstrated that you were not inadmissible criminally.

As a result, you are inadmissible to Canada for a period of five years from the
date of this letter. Subsection 11(1) of the Act provides that a foreign national must, before
entering Canada, apply to an officer for a visa or any other document required by the regulations.
The visa or document shall be issued if, following an examination, the officer is satisfied that
the foreign national is not inadmissible and meets the requirements of this Act. For the reasons
set out above, I am satisfied that you are inadmissible and I

I had read the refusal letter, and unfortunately, there is nothing you can do, unless you can prove that the PCC is actually an authentic one. Your appeal will be refused, and there is slim to none chance that the 5 years ban will be lifted.

Miracles do happen and what whatever is written in your destiny you shall have it, thanks for taking the time reading it and giving your opinion. I will let you guys know how the hearing goes.

I just heard back from our lawyer - she said Gabriel from ADR told her the interviews were not recorded. I personally think they are recorded, but why would the visa office give them to us to use against them. They probably use them internally when performing audits etc. The lawyer got them to extend our ADR unti the end of August - now we are going after them with our proofs and why they didn't follow proper procedures with not putting in notes until over 2 months after interview, not putting the date of the interview in the notes, and the person entering the notes not even being the one who interviewed my husband.
