I won my appeal on july 27, 2018 got mail back with letter saying The appeal is allowed. The officer’s decision to refuse a permanent resident visa is set aside, and an officer must continue to process the application in accordance with the reasons of the Immigration Appeal Division. Just got an email on September 13th asking for a bunch of form and med check and Police clearance.

I thought after you win your appeal all that they will ask you to do is to submitt medical check and police clearance. Why are they asking my wife to submit 0008, 5669, 5406 again. Will they make her go through an interviews again even though the appeal was won and the IAD approved the case. Will it get refuse again. I got a letter from the IAD say that the appeal is accepted and the officer decision that failed is set aside and the case officer must continue to process the application. Is my wife good now or will they refuse her again?

This is the email i got from the goverments after my appeal was success with a new UCI number:

When a judge assess your case in the full hearing, they used something call the balance of probabilities, this has nothing to do with legal argument, it is more like their perception is used. For example, I have seen cases that are very similar, both appellants were caught somewhat related to MOC in their past, they both submitted similar evidence, however one appeal was allowed while the other one was not, due to the fact that one appellant has a job and house, but the other has no stable job or hard asset in Canada. This is why they always say every case is unique, even though their circumstances are similar.

If you are rejected because of Subsection 4(1) Bad faith; what you need is someone who can help you to come up with better convincing evidence not better legal argument. In order to win the appeal, you need to pass the 2 pong test, 1. No immigration motive to gain advantage, 2 marriage is genuine.

It is good to get some professional advice just on the safe side, and I think it is especially useful for cases that are more complex. Unfortunately I am not familiar with any good immigration lawyer in the GTA. I myself was also searching for one before and I did try to look for one from the winning cases in Toronto https://www.canlii.org/en/ca/irb/, however it is much like a hit or a miss thing, very difficult to judge if one is a good lawyer. Maybe some of the other forum members can shed some light on this matter.

This is completely normal....yiu pretty much have to update the entire application. They cannot refuse her for sane reason... It would only be if there was an issue related to security or something like that.

You are welcome munimisu, and remember you can always attend other people's hearing to get yourself familiar with the settings and the type of questions that they asked. Full day hearings are available Monday - Thursday, just make sure you get there before 8:30 am to registrar yourself at the front desk on the 2nd floor and asked for the spouse sponsorship hearings. You are good my dear.... We all went through that line after our appeal was allowed. It's normal mweselake said. Nothing to worried about.
 
Pls anyone here dealing with Accra visa office? Won my appeal over 4 months now and there's no communication whatsoever from thhere visa office. Should I start panicking or is it normal for AVO?

I have seen this work in the favour of some individuals. Hoping your scheduling conference leads to reconsideration without a full hearing. I called IAD and asked about scheduling conference and was told I didn't have to attend in person as I am also living out of the country while I wait for full hearing.
If you have a scheduled conference, is there a chance that you might not need a full hearing? How does that work? Thankss!

After speaking with IAD a scheduling conference is just that. You go over the process and they schedule your full hearing date. I have not received my hearing date as yet.
 
Hi everyone! I got notice from IAD that’s my file is select for ADR so I sent all the proofs.. as well my wife take four witness with her self...now anyone have experience of adr so please guide me because on 27 September my hearing so please help me

Hey guys thank God he is real my case was so complicated even my lawyer think that we wouldn't win but we won a full hearing today got the answer one hour after the minister council heard all the evidence he broke for one hour and came and said it was allowed I know God was in control cause when everyone else say that I wouldn't win God show them that he is still in control good luck to the ones who is waiting keep the faith

Hey guys just a heads up if you was deinal because the office thought your relationship wasn't genuine and enter for the primary purpose of gain entry in to Canada if you get a full hearing first you have to prove that your relationship is genuine second you have to prove it wasn't entered in the primary purpose to gain access to Canada so basically you have to met and prove to them that 2 reason the office turn you done is not true so if you prove that your marriage is genuine and can't prove that it wasn't entered in to primary purpose of gaining status in Canada they will refuse it so make sure prove to them that both reason is not truth
