Sorry to hear. Do not despair, I shared a CANLII case number in an earlier post where it was obvious the MC was out to prevent the appeal from succeeding.
In the end, the judge voted in favor of the appeal.

It's the job of the MC to aggressively pursue their case. Any lawyer has to prosecute or defend to the best of their abilities.

You may have mentioned this before, what was the "misrepresentation"?

That is a lot of information! One thing I found interesting is how you (Annie) do not even want to come to Canada. I would try to prove that if you can. Also, make sure your husband can prove to the MC that he is wise and cannot be "tricked" by a younger woman with ambitions to enter Canada.
 
actually my case was not that much complicated. my hubby paid the debt and we have a daughter too. so they asked for written submissions to go through the case. after 2 months of submission we got letter that we minister has allowed the appeal.

Hi Wintersnow, thank you very much for willing to offer the help and opinion, my husband and I were talking about you this morning, and we both feel so appreciated. it doesn't mean i don't like Canada, it must be a beautiful, safe and nice country, just all my family are in China and we are having a not bad life in China with my husband, esp, unlike most of the couples here on this forum, we are always together, so Im not so interested in going there like very very eagerly. But my husband is a Canadian who doesnt want to immigrate to China, and he doesnt have health insurance here in China, he is very healthy right now, but with his age growing, we have to think about moving to Canada. I will tell my husband what you wrote and see what we could do together. Thanks again, a lot. Best wishes for you and your wife.

mine is also in vancouver but ours is not the adr but a full hearing. they question the genuity of our marriage so they need to interview him. ours is also in early september. well i wish you good luck with yours...i am a bunch of nerves...i wish we also had an adr but no such luck. well this waiting is horrible and i pray we all get through this with flying colors.

You see Annie ... that is very convincing. You are not moving to Canada to try to get into the country, you are just wanting to follow your husband.

Any idea how long it takes for POS to return stamped passport?

Denied April 2014 after interview at POS
Won appeal Dec 2014 via ADR.

Our appeal on misrepresentation. My husband never told me that he applied before to enter Canada, and was rejected. This was during tsunami time. In that application, his information was different from present application. There was 3 questions that he didn't answer properly.

1. How many siblings
2. Education
3. Work

That lady officer giving rude impression. My husband not allowed to enter Canada, but the judge told me she will send a letter if the appeal pass or fail. I am worried. My lawyer gave good proves, but really that officer made our case look bad.

Do you have any idea what will happen next?

As I told "mikeymyke" that is the reason for our misrepresentation.

After I read your shared Canlii...I feel a bit better, but still worried. Hopefully, God watching. We never meant to lie. It was an accident mistake.
