By the way, do you think if it makes any differences if the appeal form is sent by the lawyer or sent by me ? I will definitely have the lawyer present my case but I just want to send the appeal first if it does not make any differences. Also, I read the previous posts, someone mentioned we should have some explanation on why we send the appeal, do you think it's necessary ? Or I should just mail the form and the lawyer will explain that later when he submits the additional evidences. when does he normally do this step ?

It doesn't make a difference if you send the appeal form or the lawyer. Once you send the appeal form it will get everthing started. Before your lawyer can present a case for you, you will have to receive the blue book which is basically the whole file of your sponsorship...copies of the things you sent in to CIC, the notes on the interview and also the reason(s) for refusing to issue the visa.

I don't think its necessary to have an explaination on why you send the appeal because the appeal is its own explaination. Just mail the appeal form yourself. The lawyer can't do anything until you receive the blue book and take it to him. when you send the appeal form, the IAD will notify you that they received it and then they will send a request to the visa office that is handling your case to send the blue book to you...They say this takes about 120 days (4 months) but you can get it sooner depending on your visa office. I got mine in about 2 and a half months.
Once you have this you can start building your case with the help of your lawyer.

Hello tuoicao, yes I'm from Vietnam, I'm sorry to hear you also got refused. I'm glad you are on this thread, I learned a lot from the people on this thread. I was so panic when I saw the decision made online and didn't know where to start until I found this thread. Did you send the appeal by yourself ? Where are you in Canada ?
 
hoaphuong2013 I'm in toronto too. I filed my appeal in January so I'm 6 months into this process already. I'll keep you guys updated on how things are progressing with me so those who are a few months behind or just getting started in the process will have an idea as to how long each step takes.
 
Are you going full court or adr?

Full court in Toronto isn't 24 months like commonly stated. It's 30-36 months.

Similarly, our daughter's citizenship isn't 12 months either - as commonly stated - as we are in our 20th month.

I was worried if they didn't see I'm presented by the lawyer, they would leave my file burried in the pile :). I hope you will hear about your ADR soon. Please keep me posted.

I hired a lawyer to do the paper work for me. By aug or sept I should be getting the blue book and hoping I get adr and not full apeal. It's been stressful so I understand what your going through. Where in Vietnam are you from??
 
How to Prepare for ADR Conference in Toronto , I have conference in 8 of September 2015 .

Hi guys I really need to know if my lawyer is making me fool or not.. Actually I hired a lawyer in $3500 and she filed my appeal but what next after appeal. When we will get to know the date of hearing? Because she said that it took mostly 2 years for a hearing , like really is it true? Plz reply

Is it a full hearing? If so, where? If in Toronto, you would be very lucky to get a court date in 2 years.

Was the $3500 just to file the appeal, or for the court date representation as well?
