The reason you were refused was because the VO thought your relationship was not genuine. He would have given reasons in both the letter he sent you and his post-interview notes in the blue book. These are the reasons you must address.

Glad to help.

You should still make sure to answer every issue the VO has put in his notes. So, even though he wrongly asserted you did not have education and could not speak English (etc.) you should still prepare proof that contradicts those points. Better safe than sorry.

For instance, my wife has a child from a common law partner in China (rare ... I know!). The VO did not see a legal separation form in our package. My lawyer picked out this detail and made sure to point out that China does not recognize common-law relationships so there is no legal status and hence no need for separation papers (if only the VOs actually knew laws and customs about the countries they serve in !!!). In this way, my lawyer said, when they re-open the case after the appeal, there will be no further delays related to missing paper work.

It is important to have an answer to everything about your case.

I agree, we are going to point out all the possible mistake they made during their work on our file, also, we will prepare as much as we could for all the questions they possibly will ask. Better safe than sorry, that is exactly what my husband said, LOL, i guess, some Canadians do think alike. ;) thanks again.

I agree with you, I have no doubt they had in mind to refuse us prior to the interview. May I ask if you have to translate any emails to English ? I don't communicate in English with my hubby. I know we definitely have to translate into English otherwise they are not being considered as evidences. I can translate them all without any problem, but do I need the lawyer to verify or stamp on it that the translation is truth to the original. If you or anyone has ever experienced this. Please let me know. Thanks as always.

I used some translation software to translate all of our chats. The lawyer did not say she had to stamp them or anything.

It should be about 3 months after your notification.

Your current lawyer should not charge you a lot if he will not complete your appeal process. Most lawyers charge between $2500 - $5000 to do a case.
 
Hello all senior members who have gone through appeal process, please if you can reply that would be greatly appreciated. I recd a package from cic regarding my spouse medical, police clearance and some forms that needs to be filled. Could you please tell me where to find these forms and how will the medical report to be sent back to cic. Any information will be great help......also mrs. Malek if you can share your experience. I know you had won your appeal very recently. Thank you in advance
 
I anticipate he will ask for about 2000. Seems to be his normal fee. It's just that I am not sure he is doing a great job. I have a month or so to think it over.

i need some advice and help with a situation.

i have applied for sponsorship of spouse in Canada. i filed all the application myself as it was pretty straightforward. we did all the medical and completed all the steps.
However few months ago her passport expired, i was emailed from CIC to get a new passport and to pay for right of residence fee . so i applied for new passport and sent over the copy of passport as requested well within the 30 day limit. i also sent over the right of residence fee.
i did this via email as requested , and i received an automatic confirmation email each time.
i even called the customercare center to make sure, they basically told me that if anything , the CIC would contact me immediately.

Now today i received a rejection letter for my spouse application due to the reason they have not received her renewed passport within that 30 day time frame.
im pretty stressed over this and not sure what to do.

Please if anyone has any answers or can help ?

Really unfortunate! So you sent a copy of the passport but not the passport itself? If so, that may be the issue. You were to send the passport (not copy) to CIC. If the passport was not renewed within 30 days, then it would have been good to inform CIC and ask for an extension before the timeframe expired.

Anyway, consider writing them an email to ask for reconsideration. Explain what happened and what you did to meet the timeline. If CIC made the error, they will likely re-open the file. Hope it works out well for you.

i have sent email explaining, but no response, i am just worried that again this email will not reach them.

if there anyway i can contact the mississauga office directly? not through the call center? or what would be the best course of action in such situations>?
 
Sounds like CIC made a mistake. Two things you can do right away:
a) Forward the automail response you received and the original email you had sent, then ask for reconsideration. You can fax it too. Then wait.
b) Print both emails and take to your MP's (member of parliament) office. You can search for your MP online.

Check the original request to confirm you sent it to the correct email address that was provided.

Print the emails and highlight the dates you responded to show them you replied well within the 30 days. Then scan the pages and put them in a PDF file and send it to them too.
