Thank you for all your input and your eye on my situation, it is much appreciated!

I have been studying a lot on Canlii, especially cases with cuban spouses. In the circumstances I am in right now it would be difficult to hire a consultant. So I'm hoping that I can prepare the best I can.

I still have not heard anything from them for a date and whatnot. Better of course to be safe than sorry so I am preparing now. I try to read up and think of the questions they will ask in the full hearing, not only to prepare myself but to prepare my husband. We both know regardless of any decision we are still staying together. Whether I have to move there, or we find another country where we both can work.

Are you still waiting for your hearing?

Yes ... still waiting :(

Hi,
My file went to Ottawa. Please if anyone had same situation, if you can enlighten me. Now whats going to happen. is it everything will process from Ottawa or file will be transfer to Delhi? where they are going to request the passport? Is anyone knows how long the processing time will be?. I'm so confuse and don't know whats going on.
I called CIC but they have no idea how it will be process and how long it will take. If please someone can advice me I really appreciate.
Thank you

Hello guys I have a question please help!!! My husband's interview was not good and the officer said nothing like refused and said we will email u .. So what should I do.. Should I appeal or what.. When one can actually appeal for a case ? If they received a refusal letter or before that without knowing their decision.?? I'm confused

Hi Sh1980, I'm sorry to hear about your husbands interview. We can all relate unfortunately :(

You have to wait for the refusal letter stating the reasons why he was refused. With that letter comes the application to appeal.

I believe you have a few options at this point (is what I was told). You can either a) Appeal. b) Withdraw your application and re-apply with more proofs (once you get the refusal letter you'll see what they refused you on) and c) no longer sponsor your husband (which is the last option anyone wants!)

Until you get the refusal letter you can't really do anything when it comes to appealing.

Once again, really sorry to hear that this happened to you :(

Hi my spouse PR visa was rejected in october 2013 due to misrepresentation and was prevented to enter canada for two years. Now my two years prevention period will end by October 2015 and i have been called for my IAD in August 07th 2015. Its just another couple of months available for my prevention period so is it necessary to go through IAD or shall i wait till october and file a new application when my two years prevention period end. Awaiting for your advice.

It's better to wait another couple of months and put a new application. IAD date not worth. This my 4th interview date in August 2015. The first date they gave me was on December 2014, they cancelled rebooked on January, and than they cancelled and rebooked on March 2015. Finally, now they telling me to come in August 2015. Seriously, Immigration is a fraud making our life behind. My case was misinterpretation too. For IAD misinterpretation rejection, I heard there is 5 years ban. Better to wait another couple of months. If doubt better to consult a lawyer.

After winning full hearing appeal in Toronto, what is timeline for receiving written decision from Iad? Also is lawyer required for further paper work in applicants application? Senior members who have won full appeal hearing in Toronto if they can shed some light that would be greatly appreciated.

I received my written decision within 3 weeks.

You don't need a lawyer or consultant. CIC will ask you to update some forms, new medical, police certificate.

I had a consultant deal with mine from start to finish.

I negotiated a price for the last part. I do not deal well with bureaucracy.

On average, count on 6-9 months for COPR. Sometimes longer. Good luck !

Thank you Gsize. Was it three weeks all together or was it 15 bus days. For mine it's already 17 days and I have checked it's still not mailed out. I don't know how long it's going to take. I waited for my hearing date for 27 months.
