Hi everyone, I am new here. I am sponsoring my husband in India and yesterday was his interview and was denied. The interviewer said that he believed 99 % of our relationship is genuine cuz we've been for 5 years in a relationship and got married last year and have all the proof. But 1 technical mistake ruined the application that's why he can't issue the visa. I didn't recieve the refusal letter yet. i just wanna know if i can re-apply the application or i have to appeal?
Thank you guys,i feel so drained and emotionally broken after the result. But I know things happen for a reason.
 
If you can "fix" the mistake then it would be faster and cheaper to re-apply. If the mistake was in anyway misrepresentation though you may want to get more advice before submitting a new application. I am not sure but I would think it a pretty big technicality that would cause refusal.

Be patient... you are almost at the finish line :) Maybe another 3 to 6 months. Do you have to redo your medicals?

My wife just received letter tht appeal has been accepted by judge. She was told tht i might have to redo medical. But we havent received any letter. Do you have ny idea when shall i get tht letter.

Hi, We applied in toronto office and our appeal was filed in the same office.

See every case is different and has strong points and weak points. Our was case of not genuine marriage as we married in short time and my mom dad and her dad were not present in marriage. And first we had very short marriage ceremony.

in my case the interviewer raised following concerns:
- my wife came only for 2 weeks to india. and we only have short marriage ceromony and registration marriage. She didnt came again as she didnt had leaves.
- my mom dad and sister are in USA. They were also not present.
-my grand parents, her mom and her graands parents were closet of all relation ther werw present.
-We had small function so definately our album was short and not hi-fi one.
- i married her to move to america and they though i will leave my wife after moving.

So we prepared our case accoridingly as per points mention by them in the blue notes.
so We married again and had grand wedding in which all our family was present.

We didint hire any lawyer as my wife was confident she can win it for us. In ADR they revolve all questions on concerns raised in first interview and points mention in notes. So back all ur point with solid proof for those point. Just show all the proof u can. We send around 800 pics around 400-500 pages of printed skype call, chat details mails and all. Honeymoon pics, our bank details job details, reason why our parents cant make for first wedding and all.

The counsalor was overwhelmed to this during ADR hearing. I would advice if your sponsorship is rejected for not major reason dont waste money in lawyer.

Hi Sagar5187 ..how did you get all your skype calls history? cause mine only go back 3 months ..i need them too but as some of you know msn became skype so we lost all of our history on msn messenger..

Hi Selim,
We used skype only and and tht we got logs of last 15 months and tht was enough for us. But u can put 3 months and tht should be good.
I know msn move to skype since last 6-7 months so tht might have messed up ur call history. But if you have past mails and call details tht will be good evidence. Mails, love letters dated older than 3 months and all. You can mention in notes tht we missed past calls cause of the msn to skype.
 
Okay thx so much..we do have love letters and i also printed all fb post to eachoter over the last 4 years..
