We won the appeal on July 20. In September, the visa office sent a letter to my husband asking him to redo his medicals. Then, a couple of weeks later they sent him an email which he has never received because they made a mistake in his email address :( This email was to ask him to send forms and documents. Finally, everything was submitted on November 16 and we have not heard anything since then.

you have to apply your appeal within 30 days from your refusal to Vancouver IAD.
then you have to wait till you get the acknowledgement letter.
be patient Vancouver time is the shortest according to the other provinces.
Good Luck..!!

Hello friends,
I need ur advice....
I applied for spouse visa for 1st time in aug 2011, had interview in may 2012 & was given passport at interview saying ur marriage is not genuine.

I got married on 9 june 2011.It was proxy marriage bcoz my wife was not present in marriage & that is possible in islamic marriage custom i.e. Nikah. She didn't visited me whole year.

After refusal for 1st time, she came to india with her parents & we had reception on 7 june 2012 & she stayed with me for 1 month.

Then we reapplied for 2nd time in aug 2012.She again visited me in dec 2012 & attended my brothers marriage in jan 2013 & my co0usin's marriage in march 2013.Meanwhile we did mp enqiry & we got to know that we will hav interview.

I got a call from chc for interview to be scheduled on may 2013.

After that i ordered GCMS notes, which showed VO's comments as Call records show long duration of conversation, emails exchanged, gift reciepts, greeting cards etc...

On the day of interview I went to chc with my wife who is with me since dec.2012.
VO called me for interview & he had a copy of my last interview.
He started with why didnt ur wife visited india for marriage?
I gave same answer as of last interview.Meanwhile he saw our reception photos & her passport.
I told him that she is pregnant but he didnt saw pregnancy report.
At the end he didnt seem to be satisfied. He told me i m sorry.

But he didnt returned my passport & didnt said anything like i refuse ur application or i will send ur visa.

What should i expect?

What should be my next step to stop refusal?

You are actually living with your wife since Dec 2012 how can they refuse you ? I understand why it was rejected for the first attempt but in your second attempt You did your reception plus all normal proofs for last 2 years. If they refuse again then it will be black day for CHC - wrong decision.

Hello All,

My time line is as follows:
Spousal application filed Dec. 2011
Interview: August 2012
Visa refused September 2012
Appealed in Vancouver September 2012
Acknowledgement letter received November 2012
Blue book received March 2013
Requested for ADR in April and still waiting...grrrrr

hey there,

So my husband and I were recently denied too... so I am hoping so of you could shed some light on this whole appeal process
here are our details
applied april 2012
received july 2012
approved july 2012
transferred feb 2013
interview may 2013 (denied)
It seemed that we were denied on the basis of me being older than my husband... i am 36 and he is 28. He is and Egyptian Muslim and I am a Canadian Convert.
We have been together 4 years and married for almost 2.
I have met with a consultant and be advised that I must wait for the rejection letter which we have not yet received and then order CAIPS notes and go from there...
does anyone know how long the appeal process takes???? I hear it depends where you live... I live in Winnipeg Manitoba...
Any information would be greatly appreciated.

HI Hannah 21

Can i ask when did u apply for the appeal, and also what types of documents did you fax to the IRB prior to getting the letter stating an ADR?

I'm currently residing in Manitoba, and my husband is on student visa in London Uk but originally from India also. My appeal will also be held in Vancouver. My lawyer did fax a letter asking for an ADR, but we did not fax additional proofs of any sort.

Could you share what you sent.

Wishing you the best of luck! and a fast appeal so you are re-unitied with your husband.

Hi an kit. I applied for appeal in September I got the blue booklet from India in may 8. After wards I send additional prove such as all the phone bills from the last 9 months, I went to India for the interview in august and also in January so I sent my passport India visa my plane tickets. The pictures we took in both times of visits. Also my lawyer basically wrote a couple pages about why our marriage is genuine and any concerns they had in the interview. In Vancouver it took then 2 weeks to decide the ADR. Hopefully in another week we will know about the date of the ADR. I hope your case goes to ADR and soon all this worry will be over. Good luck
