We hired a legal counsel (cost $3000) and the appeal book is 569 pages with lots of evidences. My husband is in Morocco.

This is what you have to write and must be sent 3 weeks before the hearing. It is like a new application, but with more stuff in it... like more pictures, more emails, more msn chats, etc. We added all the phone bills, testimonies, translations of documents, travel documents, post cards we sent to each other, affidavits, etc.

We might get the visa !!! My legal counsel took 8 hours to write a 6 page letter to the opposite counsel asking him for consent in order to avoid going to court, that way money and time won't be wasted. They just talked a long time on the phone. He is conceding on many points even the age difference!!! He said he has no problem granting the visa but he still wants the full hearing to take place to hear me and my husband. He said his only concern are the cultural differences. He just want to hear us and if he is satisfied, he has no objection to grant the visa !!!!

Radhika thanks for your kind words...im sorry i haven't replied earlier...just been so busy with the baby...Its tough doing it all alone...and so much precious time wasted without my hsuband...
So I got the letter last week with my IAD . and now waiting on the file from delhi to come...So let me understand this...I am in toronto...So how long do you guys think will it be until they decide if its adr or full hearing...When i ask how long..means okay 3 to 4 mths for file to come from delhi right? then they immidiately tell you??

i have a meeting with my lawyer...end of this month...want to go to him with all the proofs that the interview officer didn't see of my husbands when he went for interview...But i want to know..the time frame..until we will know where these chips are falling.

All afternoon our legal counsel is going to practice with my husband on Skype, then it will be my turn this evening. It is our LAST practice as tomorrow is the BIG UNNERVING day! My stomach is upset and I spend my time traveling to the bathroom. I have enough of all this! I just hope I can write a happy ending post tomorrow on the Forum. Please send me goooooooooood vibes!!! Tomorrow in court for the full hearing at 1:00 pm Vancouver time, ok? :)

Inshallah all will be fine. I will be meeting my lawyer at 3.30 tomorrow myself.. I can't wait to come here and read your success....Please do keep us informed. Allah always takes cares of his followers and when things get tough...they say he is testing our iman...(which scares me sometimes) but God is Great...you give it to those stupid immigration people and show them your boss!!!!

which IAD office??

Just wondering which IAD office is better for appeal. I live in Calgary but I can go to Toronto or Vancouver if its faster there.

Secondly, how and when would I know if I qualify for ADR?
 
Hello everyone,

We recently won our appeal and thankfully our case is now being processed in CPP ottawa. It was a long wait.....more than 3 years since I filed my initial application for sponsorship.

So far they seem to be pretty fast....Appeal decision sent in mid May. File transferred to CPP in first week of June. Last week they asked us for few documents; passport photos, updated police clearance and 3 types of forms. One of the forms is IMM008 Application for Permanent Residence. They havent asked for medical yet.

Only thing is we are confused about which form to send as there are many IMM 008,and when I go to IMM 008 Permanent Resident Aplication form it says "application for business class..... I was informed in another forum that its the Generic one. We will be sending out docs soon.

Anyone else from CPP Ottawa please share your timeline.
 
My student, my legal counsel, her Moroccan husband, my mother and I have all the same feeling that the minister's counsel does not want to consent. From the beginning, we felt he was against us. I felt his vibes when he entered the court room. I felt that he just wanted to reduce us in pieces.

We went over our time and both my legal counsel and the minister's counsel did not have enough time to do their final speech. Before we left, my legal counsel asked the minister's counsel to give his consent. He refused. The judge asked both of them to submit their report in the next two weeks and then she will make the final decision.

I know I did great and my husband did pretty good, but some of his answers were contradictory to what I said and some were wrong. So the minister's counsel has serious doubts about him. Sorry to say that, but he was kind of a jerk. He kept asking questions to my husband in a low voice and my husband had a hard time to hear well. The judge told the minister's counsel to speak louder but he kept asking his questions in a low voice. Even his questions were complex and since my husband is not 100% fluent in English, he said many times he could not understand the question. The judge told the minister's counsel to change the wording of his questions, he did not. He repeated the same words.

He does not accept the fact that my husband does not want any children and that he is married to an older woman. And other many things he does not accept which I find meaningless and petty.

So we are back in the roller-coaster ride. I will leave for Morocco in 5 days not knowing our fate.

Saima..... what was the date of your appeal?
 
Hi Habibti....i don't know what more these asses want from us. I pray for you my dear. and please do keep me posted. Nothing would be better than being with your hubby and getting the good news...wouldn\'t it....but i know what you mean....u can't even think straight anymore...
i went to my lawyer yesterday...and he was teling me what al to get together...and proofs and all..i came home and honestly just cried...how much do i have to prove...how many times....im so drained...but its a fight now...and we are GOING TO WIN> INSHALLAH
