The fateful day (June 21st) is approaching... more and more sleep disorders and recurrent headaches. One more month to know our fate. Our immigration consultant is SO excited about our case. The appeal book is almost done and will be sent by June 1st. She said the counsel of Immigration Canada will be flabbergasted with all the great evidences we have. However, there are so many inconsistencies and unfairness in the world of immigration that we could expect a "no" even though she thinks all the chances are on our side to win. Also it is strongly possible that the counsel might try to find a weakness... a crack and won't let go. Let's the countdown begin!

I have my ADR first week of June, and just like you i also have sleep disorders, I wake up in the middle of the night with nightmares. My hubby told me to relax but i can't because i worry too much. I will relax when he receives his visa!!
I have an appointment with my lawyer this morning to practise possible questions and answers i may be asked. I feel sick to my stomach just thinking about this whole process. God help us all...

Hi I am new here. Just got word today that my husbands application has been denied. I have lawyers that submitted my case too. I am through ND. I am appealing this case...They had an interview with him...but have denied now...saying that it is not a real relationship...WE HAVE A CHILD !!!! and that stupid immirgation lawyer didn't even ask about the marriage...
The case isn't as simple..there is a bit of criminality as well..but its is over 10 years and nothing great...
anyhow...my question is this...I just want anyones experience here...I live in Toronto...and how long is this process going ot take...I had a brief conversation with my lawyer...and he said once an appeal is filed we could win the case in the pre trial something?? As NEw Delhi have shown themselves to be very stupid doubting the relationship...as it is as LEGIT as it gets...
Anyhow...does anyone have any idea how long it takes to get a date after the appeal is put in? and after that appeal date...how long after that does New Delhi take to process things?

I am so fed up with this crap...I have finally read this entire forum...How much strength does one have to have???
I got married and never thought it would be so long...then i got pregnant and wished and prayed everyday that my husband would be here for the time of my delivery...even that didn't happen. I was alone...then I took my daughter to see her father in the states once she was 2 mths...and then we get this interview call and are so excited...He goes to india for interview and this happens now...Im so tired of being strong...my child is 6mths...she is missing out on her father...and he too ismissing out on her...I cry and am so sick now...but i have to take care of my child and that keeps me going...
Im going to go to india and just be with my husband..until this stupid thing calls for a hearing.. bloody hell do they want DNA they can have it.
I just want our life to start...I hate this...

i know how u feel cause i went through the same on nov 15.2011 when my husband had his interview and he came out and told me that they have denied his visa...i was so sad and felt like this whole world was coming down...but got through all that with my hubby's encourgement...i send my appeal on mid of december and 21st of december got a letter from iad that they have recieved my appeal...mid march got my file back from the embassy...today got a call from my lawyer that she spoke with the iad office in toronto my file is awaiting for a full hearing but how ever she send a request for a adr. once they review my file then i might be going through an adr...i pray and hope that i go through an adr...i am still here in sri-lanka with my husband ..hang in their it's a hard process but beileve me days will fly quicker then u think..and i also wish u can get an adr..keep us posted with ur process and i have u in my prayer..

I won my appeal at the ADR, it wasn't easy at all, they pick up on every little thing and make a big deal out of it but I wasn't ready to give up after waiting for 14 months

how long u had to wait 4 a date be4 they gave a date 4 adr? r u going through toronto?

I waited for 14 months, I sent my appeal in March 2011, and I'm in Ottawa

Sent our notice for appeal last week of December 2011. We received the file back on April 10. April 19 we got the news: full hearing scheduled June 21st. Today my immigration consultant is driving downtown Vancouver to hand deliver the appeal book to the IAD and CBSA. She did a terrific job! She dug and dug and found little gems as evidences. I don't know how they could refuse us. She said we have a very strong case and we might win. I remain skeptical until the end... you never know with Immigration.

What are the criteria for Spouse sponsorship?

Do the sponsoring spouse has to work and earn?

AT LAST! The appeal book has been hand-delivered this afternoon! One copy to IAD (Immigration Appeal Division) and another copy to CBSA (Canada Border Services Agency). 569 pages of evidences! Since the books were too big for their binding, my immigration consultant had to get a hole drilled lol

o yes, unless you ,would not have, crime record,or serious medical , issues.
