Well I don't have enough information as my case is in initial stage rightnow. As far as your friend's case she has to travel back to Canada immediately and stay there for a long period and show IAD her strong connections with Canada when they ask for that. The procedure is that your friend or Lawyer will send the appeal form with refusal letter to IAD and wait for the acknowledgment letter and within 120 days they will ask for proofs and then decide for hearing date. Hope for ADR hearing.

When you have this much evidence of communication, but they still say you have demonstrated meaningful communication, it usually means that the applicant did not seem to know enough about the sponsor at the interview. The visa officer looks at it like this: if you two have really spent one hour a day talking to each other for 2.5 years, she should know a lot about your daily life. If she could not answer their questions about you, they will think it means either that you were not actually communication as much as you say you were, or that the communication was very shallow and not like the kind of communication one would expect of a husband and wife.

At the appeal, you can get around this problem: show once again the proof of the amount of communication, and then beforehand have practiced with your wife until she can answer anything likely to be asked. I know it is ridiculous, but her practicing more may be enough to convince the appeal judge she does know you well.

Hi, I sponsored my wife in 2011 June, got refused in May 2012. Applied for appeal. Just got a letter for telephone call on 13 Dec for appeal date. Can anyone help me on what to expect please or how to prepare better. thanks

"13 Dec" maybe you mean Nov ?
where will the Appeal take place ? it varies greatly depending on city
are you Appealing yourself or will you hire ?
what was the refusal based on ?
did you do the initial application yourself ?

Could someone please help me with some answers PLZ? I'm sponsoring my wife to come up from West Africa. We got married in March during my visit home. I came back and filed to sponsor her. We received email from embassy in Ghana that her interview is schedule for November 15th 2012. She went for her interview as scheduled and was denied. The reason they gave was that they do not believe that the marriage is genuine. She is pregnant by me and she's due to deliver our baby by end of this month (November). I appealed the decision same day (November 15th 2012) and now I don't know what to expect from here forward. We provided them with every documents they asked for prior to her interview. Marriage certificate,wedding pictures,copy of emails for the past 24 months,moneygram receipts and many other documents and yet they denied her. I was hoping that the baby would be delivered here in Canada but it's not likely going to happen because she's due by end of the month.
Please tell me how long this appeal process would take.
What should I be expecting from the appeal office in Toronto.
Please please help me with reliable information,thank you.

The waiting time for me in Toronto was 28 months for Hearing date, but maybe you will get ADR. I filed appeal in April 2010....case was heard August 2012. Now back for reprocessing. They tell me file will be REPROCESSED February 2013.

Timelines constantly change ! Good luck to you and yours....Keep up the fight......most Appeals win !!!!! :D

It seems to me like I'm in for a very long wait. It took 3 months and a week to get a date for her interview from the day they received the sponsorship application. I don't understand why it would take 2 years and 4 months to get an appeal looked at. That sounds like one of those rare cases.

When I filed my appeal (April 2010) I was told there was a waiting time of 12-18 months to get a Hearing date in Toronto. (that time line starts when the file comes back to Toronto-NOT when you file the Appeal) I have checked with current timelines and lawyers have told me the waiting time is about 2 years. - in Toronto

Im afraid to tell you.....going through Appeal is another ballgame. Waiting is the hardest part ! I have checked with many newer Immigrants in Toronto and most tell me.....if you need to go Appeal in Toronto---count on a good 4 - 5 years. (spousal sponsorship)

I know its not good news, but people deserve to hear the truth, and what better place is to talk to people who have gone through this horrible situation !

To only have to wait 3 months for an interview date going through Accra is a remarkably short time. Just a couple of years ago wait times for Ghana were well over a year, and among the longest in the world.
There is a longer wait time for appeal cases being heard in Toronto (and other big cities) - more than a year is normal. If you get a ADR hearing, the wait will be much less, maybe less than a year.

My hearing was May 16. I'm still waiting. My husband had to update his file in Accra because the documents have changed since we started the process, in May 2009. My dream is that they waive the medical and request him to come for his visa to travel.

That said, it's important to not be deluded about the process. I wish I knew what I was coming up against at the beginning. It should never be sugar coated. My heart goes out to everyone dealing with appeals.

No i mean they will call on Dec 13, 2012, to discuss full hearing. I did everything myself as I cannot hire lawyer, hence here seeking help. Reasons not genuine marriage and lack of trust of sponsor, i.e., I. Thanks
