Hello All,

I have a question that I would never thought I would have to ask...what is the first step of an appeal?
After 5.5 months after interview my huband went to the CHC and we were denied..outland sponsorship thank you

First of all I am so sorry you were denied. :'( Second Have you recieved your refusal letter yet? You have 30 days to send notice that you plan to appeal.I think it is from the date on the refusal letter? With the refusal letter you will be given notice to appeal form and instructions. I received everything via mail from my rep.Not sure but perhaps you can download this? Anyone?

Thank you DoubleRainbow...the husband just got it today...I have already lownloaded the notice of appeal of the CIC website...just waiting for the husband to fax his denial letter...now will CIC decide wether or not it will be a IAD or an ADR?

This is very upsetting and waste of people's time cos i don't understand why the didn't send the refusal letter to the applicants but waiting for almost 6 months. I am sorry for what happened and i encourage you to proceed with the appeal and at the end evrything will turn out very well for you. Good luck

Thank you BBC...thats why I thought it was a positive seeing it took that long..we have filed an appeal today...I didnt even wait for the denial letter I asked the hubby to fax his...sent it off this afternoon!!

I am very glad you didn't waste anytime to file the appeal and remember God is in control everything shall be well. The only thing needed is prayers and being patient in this long stressful process. Take care and all the best....

Your welcome :) Good your hubby got it yay. Fax the denial letter with the notice to appeal together. Make sure hubby signed and dated the notice to appeal.I would also send by express post hard copies of each just in case. I did this lol Double is better than single. You never know and to be safe is better than sorry. You can track Express Post also and they sign when received. I asked for this to be signed and copied it from tracking on line with Canada Post Express Post and copied the signature also lol I wanted proof to make sure they got my notice to appeal. You just never know so to be safe is best :D

Great make sure you fax/express post the refusal letter as well as they cannot proceed without it and that will cause delays. That was written in my acknowledgement letter from them receiving my notice to appeal.

Here is a sentence from the refusal letter...you tell me if it makes any sense..I too have tried sending for a visitors visa twice and was denied because of "Family Ties in Canada"....Once in 2008 the other 2010 and the Visa officer who denied us asked why doesnt your wife sponsor you...hmmm go figure eh??...Anyways here is the sentence......." I am not satisfied you and your sponsor have combined your affairs and become interdependent financially, socially, physically and emotionally." How the hell do they expect us to have any of this if they are not letting us have our husbands or wives come to Canada??? Or Immigrate for that matter? Physically?? I would love the Visa Officer to be in our bedroom when I go visit the hubby!!!

Sorry I just copied and pasted this form our Kingston post earlier..this is the exact word in the refusal letter...and they said the marriage was not legit for these reasons.

Wow that seems like a ridiculous sentence. They should've at least, listed point-by-point, all the reasons they refused, and explained why.

Maybe one way you can show physical interdependence, is pictures of you guys hugging, kissing on cheeks, etc. Maybe they saw your pics and you guys didn't seem really close? I don't know, sorry to hear that.

What were the biggest red flags in your application, and did you feel your husband addressed them well during the interveiw?

we sent all that kind of stuff picture of all 8 times going to Jamaica to visit him..sent my old passport with only trips to Jamaica in it..one picture has us laying in bed fully clothed mind you..giving each other a quick peck..we have tried for a TRV and denied because of family ties to Canada "ME" another issue wich the husband tried to explain was my sons medical problems..he is Autistic and he didnt recall the proper word for it but explained it to them how he is and behaves and the symptoms..they had stated at his interview he should know the WORD if he knows my children...asfar as that goes..he knew his problems but could not remember the TECHNICAL diagnosis.

I looked up the meaning of an "interdependent relationship" and found this: http://www.examiner.com/article/an-interdependent-relationship-will-this-work-for-you

If this is true, then perhaps they are looking to see whether both partners share a common set of principles financially, socially, physically and emotionally. That is, both persons are equal participants.

I think she mentioned in another post that she was supporting him financially- perhaps they felt he is 'dependent' on her?
If she's on disability - perhaps, this is what they mean by "physically"? Would be awful if true.
Socially - are they of similar educational background? That is, would their social circles mesh?
Emotionally - hmm... did they want to see 'lovey dovey' messages? Or perhaps they didn't see enough of emails/text msgs, etc showing that they are supportive of each other emotionally?

Who knows really with CIC? @waitingonforever, so sorry to hear this. Can you get his GCMS notes? That should have more information.
