Advice for visas for my husband to come back into Canada so we can apply INLAND

Hello everyone!

Thank you in advance for any advice you can provide! :)

I recently married my South African husband here in Canada. It was his first time visiting here and he had to go back home to tie up some loose ends before coming back to stay with me. While he was here, we talked to an immigration consultant and they said the inland application length is a lot shorter now, 12 months and pretty much guaranteed a work permit after 4 months, so we are really happy and excited about that.

My questions is on how to get him back into the country now so that we can apply for spousal sponsorship inland?? Should he apply for a regular visitor visa again and have his work say he is coming back and everything even if he does not intend to go back? He will most likely just get a one way plane ticket too, will this affect the likely hood of getting a visitor visa? Is there a better option we can do?

To get a visitor visa, he has to show evidence that he will leave Canada before the visa expires. Whatever he showed to get the TRV the first time should be enough.
He can come to Canada as a visitor, then change his mind and decide to stay, with you sponsoring him. Dual intent is allowed, but this is not something you tell the border agent (unless asked directly). However, the border agent may ask for proof of his intention to just visit Canada, and so he should have a return ticket with a specific date. In addition, airlines often will not let people board with just a one-way ticket, if they are going to a country where they need a visa.

It might be best to submit the application before he visits under 'dual intent' and that he has proof of this submission. Would also be best to have a return ticket (check out air fares, often a return ticket is cheaper than a one way ticket!). He can be admitted under a visitors visa for up to six months. He can apply for an extension of this visitors visa if necessary.

Thank you both so much! This helps us a lot! I think since he'll have the work letter saying he's coming back we will be okay with the TRV, from what you've said, and we will get a return ticket so nothing goes wrong at the border :) Thank you!!!!

Instead of buying a round trip flight you can buy a separate one way ticket back to South Africa - you get more money back when you cancel a flight vs. not taking the second half of a round trip ticket.

I'm from the country that needs entry visa and I entered Canada wth one way airplane ticket just fine. I agree it better to have a separate return ticket just in case but it's not mandatory
