Does the 5 year bar apply to the person who was BEING sponsored OR the sponsor? thanks.

Hello Members,
I am very worry about my eligibility of sponsoring my husband. Can someone give me some advice?

Me and my ex-husband just got divorce certificate, we married in 2008 and i sponsored him,he landed on October 2012. He met another girl during the processing time and decided to leave me after he landed...i went back to our original country spent two years to save the marriage and waited for him to come back, failed. I came back to Canada in 2015 and met my current husband now.

He is my high school classmate and currently lives in Seattle, US green card holder. I work in Vancouver and want to sponsor him to come here and start a new life.

As far as i know, my ex-husband never applied Canadian PR card after he landed in Toronto, because he has no intention to come back to Canada as he decided to marry the other girl.

Can I file sponsorship application now? after 3 years my ex-husband became a landed immigrant, i remembered that i am financially responsible to my ex-husband after he landed, am i clean now? I have no idea where is my ex-husband or what he did towards his immigration paper, we never spoke ever since...

I am so worried that i cannot get out of previous sponsorship! Wait for answers anxiously! Thank you everyone.

i remembered that i am financially responsible to my ex-husband after he landed, am i clean now? I have no idea where is my ex-husband or what he did towards his immigration paper, we never spoke ever since...

Yes, 3 years after he landed your undertaking ended so you are free to sponsor someone else.

The only concern would be if he took welfare while PR you would need to pay it back, and couldn't sponsor someone until your debt was clear. However since he never actually lived in Canada I don't think you have to worry about that.

Thanks so much to reply me!! I just went through CIC web and saw that 5-year bar is applied to him (the one who is BEING sponsored) not me (the sponsor), although I am not sure if he's ever came to Canada after he landed, but he won't took welfare so 3 year passed. Also, we never had a kid, so that 10 year financial responsibility does not apply either. I guess I can start to a new life...

Please help-Still confusing... Cic agent disnt actually answered..I am the PR, I sponsored my ex-husband on 2012. Divorced now.Does the five year bar apply to the person who was BEING sponsored, right? Not the sponsor? In my case, 5-year bar applies to my ex, is that correct? Thank you.

Corrent. 5 year bar does not apply to you. Only the 3 year undertaking you signed up for as a sponsor.
