Question: I am in the pool on 468 points, hoping for ITA next draw. I am on IEC which expires Nov 21st. I was told to submit a open work permit application to gain implied status. Do I need an ITA before I do this? As of this Wednesday it will be 30days left on my Visa, which I was told is the deadline for applying for an open work permit. Could anyone please give me advice? What would you recommend in my position?
You won't get implied status to continue to work when your IEC ends. Read this, all of it, links included, VERY carefully:
http://britishexpats.com/wiki/Implied_Status_IEC

If you apply for an OWP in your current situation it will be refused.

30 days before your IEC permit ends is not a deadline to change status/conditions, it's a recommendation.

If you wish to remain in Canada after your IEC ends, while awaiting your ITA & eventually PR, you could change to visitor status (just make sure to apply before 21/11). If you get an ITA, once you have AOR you could then apply for an OWP.

People who are narrowly missing the 450 cut-off mark should really try and increase your scores. Do not and I mean do not wait and see if the scores will go down in the future draws. Do something about it. CRS might come down below 450, then again it might not. At this point no one knows how CIC will regulate this. If you really want to migrate to Canada or stay here, you would do anything and everything to make it possible. Do not rely solely on the hope that scores will go down. People who are leap frogging you and getting ITAs are probably doing something that is working for them. Don't sit around. Be ruthless when it comes to immigration (there are only a limited number of ITAs and way too many applicants). Its every man for himself out there.
Most of us are NOT just sitting around. And the people who are "leap frogging" us are doing it because they have 600 points from an arranged job offer. We got our 400+ points based on our credentials, that's our sweat and blood. What do you suggest we do?? Go and have a master degree while waiting? Or should we go back in time and reduce our age? Most of us have good results on our language tests, and we're good at what we do. We just dont have those 600pts.

Dont talk down to us man. Some of us have great jobs and we've been paying taxes for the last ungrateful government for years now, we're just a number to them.

very well said I am tired of these condescending and immigrant bashing posts. Immigrants hate immigrants the most.

Thereby proving that they, and their skills, are *needed* by/in Canada.

If you actually bothered to read the rest of my post, you would see that I do in fact have a job. My employer needs me, my company needs me. But the system is stupid. I am actually a manager in my company, I earn good money, and I pay taxes. I am giving back to this community. How am I different than someone with a job offer. I already have a job!!!!

So you actually agree that an idiot who doesnt do well on his language tests, and doesnt have degree, but has a job offer, is better than someone with a masters degree, speaks the two languages, but doesnt have a job offer. 700 > 450??

The 400+ points are pure skills, whereas the 600 points that were given to the first guy do not mean that he's any better.

I think we may be misunderstanding each other :(.

However, just because someone doesn't have a degree, or perfect English, does not mean that s/he doesn't have needed skills/qualifications/experience.

I *do* think that if a company is prepared to go through the time, expense and hoopla to successfully obtain an LMIA, that shows a *need*, and I don't look down on the person who gets that coveted 600 points as a cook or a plumber (for example), just because s/he doesn't have a degree...

Do I think that those on PGWP were short-changed by the introduction of EE? Yes, somewhat.

But let me ask you this: if you had to leave tomorrow, could your employer replace you without having to resort to an LMIA?

Yes.

But that shouldnt be the question at all. Do you wanna tell me that if that chef or plumber left tomorrow, all the restaurants will close down, and all the sewers in Canada will be clogged??

This country was built by immigrants, each one of us does their part. I think its hypocritical to say "Nah, we dont want you as an immigrant here, because you dont bring anything good to this country." How good did the Europeans bring to the indigenous people in this place??

I very much hope I don't come over as condescending!! I got PR aeons ago, & try to see both sides of the equation.

Sometimes when I read posts by PGWP holders (for example), I see them as somewhat condescending towards prospective immigrants who don't have a university education, but whose skills are required by Canada.

I totally "get" the frustration & anxiety of those who are highly qualified, working here, etc, who can't "break" the 450 point barrier.

I'll add that 20 years ago, Canada didn't give a sh** about my university education. It was practical qualifications & experience that "got me in".

But I didn't say that :(.

I can give you a concrete example that a local employer has just had to close for the winter, because she just cannot get local qualified staff, & the renewal of the head cook's LMIA has been refused because his language skills are not good enough - although he did get a WP on the old Lmo system.

agreed then why EE asks for both and that too very high level to get 450 points. Doesnt that say system is flawed?

I *do* think that if a company is prepared to go through the time, expense and hoopla to successfully obtain an LMIA, that shows a *need*, and I don't look down on the person who gets that coveted 600 points as a cook or a plumber (for example), just because s/he doesn't have a degree...
no not necessarily. There r companies who can just easily move the job to cheaper countries than doing LMIA process. Also small business have difficulty finding people.. degree has nothing to do with it I am saying canada does not need cooks over a nurse or even a plumber Trade skills are needed. So the question is doesnt canada need both plumber and a nurse then why only one of them gets it as only one employer is sponsoring for LMIA. Why isnt a nurse getting LMIA or a plumber for that matter but a cook is getting one? Because system is being played with.

Do I think that those on PGWP were short-changed by the introduction of EE? Yes, somewhat.
agreed

In my case I am sure he cannot. My position was open for better part of a year before I got the job. The guy who was trained by the company just to fill in, in that time was making so many mistakes I am still cleaning that mess up till now. Another option for the company was to move the position to US. They have already closed units in canada before. When that happens who loses both canadians and us both. My boss wants me but getting all the approvals for LMIA will be an up hill battle for him as well as me.

I hope that the draws don't come to a stand still now that there is a new government. And the Liberals might even choose to eliminate the EE system and bring back the old FSW and CEC programs.
