My understanding is that if your application was received before your visa expired then you have "implied" status pending the determination of the application. You therefore will not need to apply for restoration.

miguelre, you can be lawfully admitted to either the US or Canada. We meet the latter requirement. See CIC Buffalo's website under "Family Class" for confirmation. I tried to post a link but I'm not allowed to, but it's easily Googled.
