Extending Visitor Visa - Restoring Status

Hello! I've been in Canada since November 13th 2009. I originally came in wanting to stay for a 6 month period, and I was given til the end of January on my stay. I applied for an extension around the 4th of Jan, and I received a letter from Vegreville that they had forwaded my application for extension to a local dispatch in Edmonton, that letter was post-marked on Feb 25th.

My question is, if I don't get a yes or a no before my 90 days run out (90 days from my original date to leave, being the first of May) is it ok for me to apply for a restoration of my visa a week before May, while still awaiting the first response for my extension?

I'm asking because IF I happen to get declined my extension AFTER May, then I'll have no choice but to leave within 30 days, correct? However, if I file for restoration and send that off as well, assuming I get a decline after May I could still stay and hope to get my legal extension on the second try, correct?

Any advice or acknowledgment would be appreciated!

My understanding is that if your application was received before your visa expired then you have "implied" status pending the determination of the application. You therefore will not need to apply for restoration.

However, my implied status would be taken away if I get turned down for my extension after May 1st and I'll have to leave. So I'm wondering if I send off another application before then, I'll still be able to stay until the next response?

I doubt that sending in a second application would work, as they would have made a decision.

If you are allowed to extend your visa, then yes, you can reapply to extend again, and if an extension is granted - again, and again, until refused.

But if you are refused an extension, typically you have to leave the country (what I would suspect as no status to stay).

I would suggest that resubmitting an extension after you have been refused is not like an appeal, otherwise there would be no point in CIC making a decision in the first place.

My question is simply this. Can you send off another application before your first is back? What if my first got lost in the mail or something? If I send another request before I get their first response back, would that give me a fresh implied status until I get that response?

Note that CPC-V has received your application and in fact has forwarded your request to a local office.

Processing times for your application

CPC-Vegreville completes most of the applications it receives, however, a small number are referred to a local office for further clarification. If your application is referred to a local office, they will contact you to obtain additional information or clarification. It may take up to three months for them to contact you.

You have to wait till the local office contacts you. Meanwhile, you are on implied status.
