Thank you, my friend. I owe to this forum a lot and happy to share with friends everything I learned over the past years. If I did not learn here years ago that we can order GCMS notes to see refusal grounds and re-submit H&C ourselves, our multi-year IRCC saga would not have had a happy ending.
This forum has helped many friends in dire need . Sharing is just like giving and "Giver is the Great" A kind word and good advice restores peace of mind to those who are waiting the outcome of H and Cs. I respect @Ayaana for guiding friends also.

You are better off submitting a new application than applying for JR. Lawyers like to recommend it because it is another avenue they will you will milk your bank account dry. I am talking from experience. I am sure virtually everybody in this group will agree with me.

I almost got scammed by a lawyer that told me she did a JR for me. I never had any discussion about JR with her. As a matter of fact, at the time, I did not have a copy of my refusal letter with me. IRCC did not send me a copy. Also, the lawyer did not have a copy. My question to her is, how was she able to do a JR without knowing the reason for my refusal ?...this question made her look stupid. I requested a copy of the JR application she claims she did. when I read it, my jaw dropped!... Believe me, when I say this, a bright high school student will do a better job than her. All she wrote as an argument was all GENERIC argument that has NOTHING to do reason for my refusal. Bear in mind that at the time, she does not have a copy of my refusal letter.

I am yet to see anybody in this forum that has got their application approved through JR... It is not an application that is in a client's interest. Rather, it is application lawyers use in wasting their client's time and milking their bank account dry!

I am glad I asked these questions on this forum. everyone seems to have similar responses on these issues. I honestly believe a new application will serve me better. Thank you

Hey guys i made a post on here a few weeks back
https://www.canadavisa.com/canada-immigration-discussion-board/threads/h-c-humanitarian-ground-with-or-without-failed-refugee-claim.550176/post-9813325

Just wana follow up with what is happening with my situation lately,i had a 1hr long meeting with my new lawyer and was told that i need to get a whole list of different things such as employment records for the years i paid taxes, notice of arrangement, police records of the abuse and 911 callouts, volunteer work, join a church and ask priest to write me a letter after i attend mass there quite a few times to help my case etc ,

these things are gonna take weeks if not months to get them all ready before submitting my application and right now as of the time of writing my sons mom wont let me see my own son and it has been a week ,she says i can see him only when she decides and clearly doesnt care of the hurt it is causing my child not to spend time with hes daddy.she is very pissed off with me because i refuse to get back together with her and is using my son as a revenge.

She has quit her daytime job and is now working as an escort alot more ,i take screenshots of her ad postings, i am worried for my sons health because i know hes mom(my ex) would see too many clients every day she works at the brothel and im scared she can give my son an std when she kisses him on the face or lips .

My plan is too have my application in process so i cant be deported and then tell my ex whole family ina fb messenger group chat with screenshots of her escort ads and lots of evidence and proof etc and at the same time file for full custody of my son,its a very messed up situation i am in any advice would be greatly appreciated

You will still have some couple of interviews, before they ask you to buy ticket. Once you buy tickets your departure will be between 3 weeks to one month. If you are going for the next interview, go with your entire family, especially if you have kids, most times it makes the Cbsa officer feel some compassion, you might get administrative deferral, it has worked in some cases. One more thing ,After expressing your fears of going back home ,If you are asked , "if you will leave Canada when you are asked to leave?" just answer them , you will leave if the law say so.
Thank you so much my friend

Ys,

Exactly, I started getting anxious and I started to look over the internet, then I found this group and I was like whaaaaaat?! Aip, Corp, processing? Lol my status online says received lol, and I read many received notifications and they applied 2021....I was like whyyyyy
It's nerve wrecking just waiting. There isn't any encouraging words anyone can provide to make us feel less anxious. If you wonder too much, you can order gcms notes to have an idea on whats happening.

I recommended you the lawyer who helped me. He works my entire application. The lawyer is a registered lawyer in the province of Ontario the lawyer who help me knows how to deal with this family violence issues.

one more thing I only paid 5-8k CAD and its two way give if he knows that you cannot pay full because of your situation.

One point to note, and I think not many realize it, is that the successful outcome of JR is not an approval, but rather judge's decision that application should be reconsidered by another officer. And guess what? That new officer still can reject your file! So, whether you do JR or a re-submission, your file still has to go to another officer: with JR, you are just adding an addition layer of complexity ($$$$ + long waiting).
You are 100% spot on !

Sorry to hear that. Yes, it takes months to gather all the evidence for your application. One possible avenue is to apply once you have all the core evidence, and you can always submit additional docs via webform later. This is what we did - our family doctor took ages to sign our reference letter so we submitted what we had and a month letter I added her letter as webform. There is of course risk that your file would be opened by the time you sent additional evidence and the officer may disregard the new piece (happened to us but on a different occasion - not with this letter). So I would try to gather as much as possible and not annoy officers by multiple submissions.

Also, an application going into process does not delay deportation. You have to get approval in principle (stage 1) to get CBSA off your shoulders. Of course, your CBSA officer may turn out to be nice and give you administrative deferral once you go into process, but this is not something that will happen automatically. Lots of hard work and patience needed. Good luck!

Before an application gets to "process", should in case an applicant choose to provide more or updated information about the change in their circumstance, what means would you suggest is best to send the evidence/information to the IRCC office and to ensure it will get to the H&C officer that will be working on my application receive it.

Webform or mail ?....what is the reason for your answer

I always used webform and it worked great. We used to get email confirmation that form was received and also it showed up on GCMS notes.
