Hello all,

We applied for my spouse's PR application in Family Class as Outland (new delhi) and received Sponsor Approval about a month ago saying the file is moved to New Delhi visa office (also just completed medical). My spouse lives with me in Ontario but we applied outland because she needed to travel out of Canada due to family reasons.

Based on the following I post I understand that we might be able to apply for OHIP.

OHIP is only available for those who applied for inland PR sponsorship and gotten AIP stage and also available to those who have gotten OWP through inland sponsorship providing they submit an letter from employer that he/she is/will be employed full time for a minimum of 6 months.

Those staying in Ontario while on outland application are considered to be "visitors" only and thus not "officially" residing in Ontario. This is why OHIP is a not available for those who applied for PR through outland approach.

Hey @jn1234 , I am a Canadian PR living in Ontario and planning to sponsor my wife as Outland Application (India) who will be moving to Montreal (Quebec) on work permit from her company side. My husband was an outland but he was approved and now in canada we needed a bunch of documents and him to be in the office with his landing papers we applied not even a month after landing but it can take a while to get it back.

Hi. Can you share what path did you follow and what was outcome? did they give her health card while being visitor and during process of PR application (before the PR was granted) ??

Eligibility criteria changed in 2024 so old posts aren’t relevant. Did you apply inland or Outland? Does spouse have OWP and are they working? Are they settling permanently in Ontario and will they be travelling abroad and for how long?

Oh thanks for clarification that rules changed in '24 because i was going through OH website and then these forums, and some of the things weren't making any sense. I inquired with Service ontario as well, seems like they were not quite confident about the information especially what we receive from IRCC.

About spose, she is Currently overseas, but will be here in a month or so. Trying to assess if OH will issue OHIP to her after she arrives and has spent 153+ days here (OH's requirement about residency).
currently she has a visitor visa (multiple entry, however with max 6 month stay at one time), does not have OWP, not working. Yes, will be settling in Ontario, may or may not travel abroad so it depends on situation, we're flexible on that.

OHIP's eligibility requirements are (among residency/ having spent 153 days in Ontario)
  • " are applying for permanent residence in Canada and:
    • have submitted an application to Immigration, Refugees and Citizenship Canada (IRCC) and
    • IRCC has confirmed they have reviewed the application and that you meet the eligibility requirements to apply (see document requirements) and
    • you have not yet been denied "
want answers for:
1) whether the sponsorship application submitted needs to be "In-land spousal sponsorship" or can it be "Outland spousal sponsorship" as well? for getting OHIP while PR is not granted i.e. application in process.
On the basis of this, I will decide if I need to apply for "outland sponsorship" now. However, if OH need application to be "In-land sponsorship" , then i will have to wait a month or so and then apply "In-land sponsorship".
2) In regards to OHIP's requirement in point 2 above "... that you meet the eligibility requirements..."
a) are they referring to having received AIP or AOR from IRCC ?
b) if AIP, can it be expected to arrive after approx. 3 months of application, per current IRCC processing times on their website (inland 12 months, Outland 10 months). or does it arrive towards the end of process like 8th or 9th month?

What does it mean that you don't need to wait 153 days? I thought someone needs to be present in Canada for 153 days in order to apply for OHIP.

No, they can apply when they arrive/become eligible for coverage. The constraint is they must be in Ontario/resident for the first six months (or no more than 30 days away in that period. In other words, 'planning to...' - someone who arrives in Ontario and leaves / spends more time outside is ineligible.

Do they track people down who make use of OHIP for coverage when they violate this (eg and charge them for health services rendered)? They can, and apparently sometimes do.

This is also important in that someone who arrives, gets OHIP, and then (at whatever point) leaves for lengthy periods becomes ineligible, and if they return, they have to apply again.

Of course, some will say they didn't do this, and 'nothing happened' (or similar). But the fact that not everyone is caught speeding doesn't mean speeding is legal and you can't be fined (or made to repay OHIP if your coverage wasn't valid).

Thank you so much. While I was waiting for answer in this forum, I called Service Ontario earlier and they gave me exactly same answer. Now I know, I will apply for it.
