Hi all. We received a request for additional documentation (an updated police certificate) right after the AOR1. I was really hoping to receive a request for a medical so I could get it done while we are resolving the PC issue. In your experience, does the request for additional information completely stall any progress of the application (i.e. its transfer to the VO, request for a medical, etc) until it's satisfied, or could things still happen?
NB: we also received sponsor approval yesterday, and the letter also said that the application shall be transferred to the VO, but now I am not sure whether it would be transferred only once I've submitted the updated certificate, or these processes are not interdependent?

As for them requesting medicals etc, I think the main question is if they are actually working on your file or checking if it is complete to proceed. However it is I think submitting the PC would speed it up since you been requested at an early stage.

Hi,

I know to meet residency requirements, so I plan to rent a room in Canada so that I have residency proof. How did you handle such situation ? Would IRCC check travel history ? Can you suggest any alternatives or any suggestions are appreciated.

Anyone have prior experience to this or has gone through it? How long does it normally take to hear back from them afterward?

In order to sponsor your spouse as a PR, one of the mandatory requirements is that you be living in Canada.

What you are planning to do will not be classified as living in Canada by IRCC. You will still be living and working in the US.

You will need to wait until you have actually moved to Canada (i.e. are physically living in Canada full time) before you will be able to submit the application to sponsor your spouse for PR.

Yes - IRCC will have easy access to your travel history. Canada and the US share this information.

I suppose an alternative if you want to sponsor your spouse now is to find out if your employer will allow you to work remotely from Canada. If so, then you can make your move to physically live in Canada full time and then apply to sponsor your spouse. If this isn't possible, then submitting the application will need to wait until you have actually moved to Canada.

Hi everyone, struggling to find an answer to this so hopefully someone has been in a similar situation and can help with it.

I am a UK citizen and have been in Canada since 21st October 2020 (applied under the extended family reunification process and got married to my Canadian Wife in December 2020), and applied for an extension in March.

I plan on staying in Canada until i find out the results of my extension, hopefully get approved for a further 6 months which will take me to September time roughly, and then returning to the UK and coming back every few months for short visits.

The issue i am having is what class do i apply under for the 'Class of Application' section on the sponsorship forms.

Whilst i am living in Canada with my sponsor, its not permanent as ill be going back to the UK and im not working in Canada (im working for my UK company remotely here though) so im still classed as a visitor so i think the 'Spouse or Common-Law Partner in Canada Class' is not for me.

Now the next options are Family class, either currently living outside of Canada or Inside of Canada.

When i submit my application il be inside Canada, but ill be leaving later in the year.

So is it best to select the 'inside Canada; family sponsorship' option as that is my current situation at the moment?

Any help or info would be appreciated.

The primary benefit of the first option ('inland') is eligibility for an open work permit sometime before the PR (at the price of expectation you will remain in Canada throughout). If you don't care about the open work permit (and it sounds you don't), go the other way.

I am in a sort of similar situation, but we just started our process recently - so hopefully someone with more expertise can advise as well.

In my opinion, if your end goal is the permanent residence, you are better off as an outland family class applicant.
I am in the UK while the husband is in Canada, we also got married in December 2020. Got the marriage certificate in March, and then applied under outland category while I visited this spring.
I can't comply with the conditions of the inland family sponsorship (not leaving Canada while your application is in progress) as I need to be in the UK at the moment.
An inland application gives you a work permit while your application is in progress, but no freedom of movement. With the outland application you can't work until the process is completed and you are granted the PR status - but you can leave Canada (and hopefully come back, I still haven't tried since we started the application).

If I were you I would start collecting the documents for an outland application so that you can prepare the package and sign off on all documents before you leave the country, and if your aim is to be flexible in terms of your movement in and out of Canada, then outland appears to be the way to go.

Thanks for the response. That's right im not bothered about the Work Permit as i have my current employment contract for another year so from that point im all good. Its just the inland/outland im reading about thats getting me confused, as technically i am inland but ill be leaving at some point.

So to be on the safe side select the 'I am currently living in Canada, and i am applying under the Family Class.' option even though i may be leaving later in the year?

If you are worried about the fact that as of this minute you are still in Canada, consider this: it will take you a few weeks to collect all the documents (UK police certificate alone takes 2 or 3 weeks), and then they won't process your documents for another 4-5 weeks or longer. By then you'll be back in the UK and definitely outland.

I already have all of the documentation, I ordered the police certificate in advance of completing the application knowing it’s valid for 6 months, done ielts and medical ( done these as part of express entry but I missed out by 2 points so now going down spouse sponsorship rather than wait for next draws )too and all application forms complete.

It’s just going through the checklist I started to get worried about the class of application question on it.

She definitely can do any of both once she is the sponsor how ever she wants, just make sure she sends it to the right address because I realised when you mail it has an address to go to and by courier another address. Don't remember much bt ask her to check before sending.

Personally don't think this is necessary, because if it's about checking updates both of you can do that individually via ecas with your UCI's. And also I think there are extra required documents which would just make your file larger than normal. Hehehehehehe spoken as a an amateur hehehehehe.
