Hi-

I have two questions regarding supporting documentation that I need to provide to sponsor my husband and kids to come to Canada. Quick background, I am a citizen of us. We all currently live in the US. Our plan is to move to Toronto

My questions:
1) On the checklist, item #2 says that if we are living outside of Canada now that we need to provide proof that we will live in Canada once they become permanent residents. What type of proof should this be? Employment offer? Needless to say we don't own or rent a home there yet since we are probably at least a year off from moving...

2) On the checklist, item #5 is looking for Employment/Source of Support info. If I put that I am unemployed due to covid-19 detriment to our application? Also, it says to print a "Notice of Assessment", but since I have been working/living in the US I don't have one. Should

My husband (Canadian citizen) has been out of Canada as a student for 7 years and we put my PR application in back in Jan (we are all in the US). When we applied he did not have a job offer in Canada. We haven't received SA yet (just got AOR and biometric request on March 25/26th) so I am not sure if what we included will be helpful or not, but here it is in case it is helpful:

- We included a detailed table of the jobs he had applied for (probably 30ish jobs at that point) including date applied for, date asked for pre-interview exam, date of interview etc

- We showed that he has maintained a Canadian bank account and credit card

- Mentioned his frequent trips to see his mom and grandma, and that he has been back for several weddings of friends (trying to show evidence of maintaining ties to Canada)

- We mentioned having looked at houses/apartments (online of course - we thought about contacting a real estate agent but honestly it fell through the cracks)

- We emphasized that we've applied for our daughter's Canadian citizenship (quick question - you said you are sponsoring your dependent children? If you are a citizen, I don't think they can be sponsored. Are you a US or Canadian citizen by the way? Since you said you're sponsoring I would think Canadian unless you are a PR yourself in which case you have to be in Canada to sponsor, but you said that you are a US citizen.)

He did recently get a job offer, and once we have the finalized job letter with a start date (it is with a federal agency and my has it been slow as they do their background checks!) we will be sending that in via webform with a note explaining that he now has a job in Canada and is moving there on X date.

thank you very much for the reply, my wife is canadian citizen im the principal applicants, i think she still have the canadian bank account maybe i can provide that for prove , i see i think im gonna look for an real estate agent maybe communicating through email, and maybe do an screenshot of the conversation, to prove that we will reside in canada once the pr is approved we have two kids toghther so my wife is sponsosor type a dependts, im not an pr im jst a citizne of us, intersting what happen if you didn't find any jobs in during the applications for the pr how would i explain that please help do you tink that if i say we will be looking for an job once we arrive to canada? do you think that is enough support?

- I don't think she can sponsor them as dependents because if she is a Canadian citizen they should be eligible for citizenship so she should be applying for citizenship certificates for them not permanent residency

- No idea what would happen if your wife doesn't find a job while you are applying for PR - sorry! Since she is a citizen she could always go to Canada and find a job while your PR in in process. I also don't know if saying she will look for a job once you have PR is enough. Sorry!

Planning for what kids will do (eg schooling, even if looking into it) is a good form of evidence of intent to move to Canada. (Not sufficient alone but helpful)

Repeat though: if your spouse is a Canadian citizen by birth or by naturalisation, she likely cannot sponsor her children as dependents - because they are presumptive citizens, and Canadian citizens can't be sponsored to become permanent residents.

She needs to look into it ASAP and apply for their citizenship before applying to sponsor you.

(If she is a citizen by descent, ie was born abroad of Canadian parents, then the children likely have no claim to citizenship and would be sponsored).

But you both need to look into this and clarify ASAP.

This depends on whether they're the second generation born outside of Canada. If your wife is Canadian AND born in Canada, the children are basically already citizens, and would probably need citizenship certificates to make life easy.

If your wife is Canadian BUT born outside Canada AND the children were born outside of Canada as well, they would need to be sponsored for PR first.

Descent
Any child born outside Canada is Canadian if one of the parents was either born in Canada or became a naturalized Canadian before the birth of the child.

• The Citizenship Act limits passing citizenship to the first generation born abroad.
• This first generation limit provides automatic citizenship to a child born abroad if one of the parents was born in Canada or was a naturalized Canadian at the time of birth.
• Any child born abroad in the second generation (or beyond) may seek citizenship through naturalization.
  • The Canadian parent may sponsor their child for permanent residency.
  • The Canadian parent may then apply for a grant of citizenship for their minor child, with minimal requirements needing to be met.

hi she is canadian citizen by naturalisation, i think i put the two kids on type a depdent, my wife is sponsoring me (us citizen) to become pr in canada. shes is not a citizen by descent

We wrote a combination basically like this:

- Greeting to whoever reads
- My husband mentioned his name and that he was sponsoring me
- Said why is is outside of Canada (attending school) and mentioned that he met me here and we have a daughter and we've applied for her citizenship certificate
- Said why we are applying now for PR (he's finishing school, looking for jobs, desire to return etc)
- We had a couple things to explain (outside of Canada so explaining intent to return, and we've been married just shy of 2 years so we had to include the additional relationship proofs) and for each one there was a brief 1-2 sentences about the thing being explained and then a list of the documents/evidence we were submitting for each
