Study permit refused, need advice.

Your comment was clear as crystal. Thanks for that. I also think that I did not make a strong SOP. Well it is my first time apply for visa. I will wait for GCSM and already deferred my study to Winter 2021, so I have a lot of time. About ties in home country, in form I have declared that my mother, which she is a widow, will not accompany me. Probably I should state this fact. Personally I don't think that property is a bigger reason to come back than my mother left alone.

Mother being in your home country won’t be considered a strong reason. You are right.

Well I did not though this way. In my opinion if a family runs out of money, they will return back home rather than to stay illegally. In Europe I did not had many opportunities because lack of language and not recognised degree. In Albania, it does not really matter if someone has University Degree from back 2010. More prevalent are degrees from Europe. But knowledge is most important. Technically speaking, the IT knowledge that i gained back in 2010, is very old, since technology is changing every day. Think that on that time, no one was speaking for cloud computing, etc.
Sorry to bother you guys with my long comments. I am not trying to explain this things to VO, but rather have a great conversation with all of you.
Your family joining you will be your biggest issue. Having family join you when you are doing a more entry level degree and don’t have your own funds is unusual. The expenses when you bring a family are significantly higher for both you and Canada. Many who run out of money actually don’t they usually work for cash and try to find a way to remain in Canada for H&C reasons. It is extremely expensive to remove people that is why the visa process is so difficult to enter Canada. We still have over 500k people living without status in Canada.

How do you possibly justify spending so much money to get a Canadian diploma? It is not likely that it will benefit your career when you return to your home country. Honestly ask yourself that. The cost of getting your diploma in Canada outweighs the economic benefits you'll get back in your home country. There is no possible way that you'll earn back enough to cover the costs.

Also, many people that would fit your profile has in the past abused the study permit and go "missing" after arriving into Canada and not even enroll into the university that they are supposed to. Which puts higher scrutiny on your application.
This is such a judgmental statement/opinion coming from someone who is a stranger to the person seeking assistance. Unless you personally know him/her and even then you have no right to make such a statement.

Thank you guys for your support. Honestly I did not got offended, in contrary, such statement did help me to build a strong SOP to convince VO if he has such opinion about a stranger like me. But you are right. People should not be judged from outside.

My friend, I will be honest to you and all members of this forum. I did not hide the will to stay if I would graduate and apply for PGWP. If I will come back in my country, for sure it open me many possibilities for higher salary. Right now my salary is 1000 CAD per month and the average is 400 CAD. There are many foreign companies that need skills people. It is also true that for the moment I did apply, I had only 1000 CAD in my bank account, but it was not like that all the time. Also with my degree from Albania and Canadian diploma, there are many possibilities in Europe. Don't forget that fact. Another important fact is that my english language will be better and because I can live in Quebec, also I will also learn french. For this reason, frankly speaking, I have nothing to loose. For this reasons I see as investment for my life. Please try to understand me. I have lost 10 year not having enough knowledge about changes of computer technologies. Where I will be after another 10 years if I don't invest now in my future.
The is no law preventing you from staying in canada after your studies.

What the visa officer sees is whether staying in canada is you ONLY option. If staying is your ONLY option, then no. you would be denied a permit. If staying is ONE of your options, then it will be seen as a positive application. The visa officer cannot assume you will complete your education.What if you fail and get kicked out of university? what if you fall ill or get into an accident and cannot continue to study? what if you run out of money? Where do you do when if you no longer able to study or after you graduate and don't get a pgwp? If you have weak ties to your home country or if returning home is not an option for you, then the visa officer will deny the permit.

A canadian certificate program diploma wont' serve you any purpose in your home country, you know it, the visa officer know it, everyone knows it. the economy is in such bad state, there is no logical reasoning that you will need to spend thousands of dollars on the piece of paper that is worthless in back your home country to get any job there. So there is absolutely no purpose of your visit. The only logical reason is that you're not going back home and using your canadian certificate to get a job in canada.

Just received CAIP notes:

Family of 5, applying for SP, WP and TRV respectively PA accepted at College Lasalle in Computing IT college program. PA already employed as an IT specialist proof of funds provided Notorial Declaration, letter from the bank showing savings of 68,975.00 CAD Wife employed as Senior Specialit at IT Projects Family will be staying at a relative’s house. Not clear how host can accommodate a family of 5. Not satisfied that study plans are reasonable. I am not satified pa’s motivation for pursuing studies in Cda at this point is reasonable and submission demostrated a level of establishment outside Canada sufficient to to motivate their departure by the end of an authorized stay period.

I think that VO clearly did not read my application carefully.
First it was my SIL who made notorial declaration and not my wife. As IT Special is working my SIL, not my wife.
I have provided a declaration and bank statement from my family closed friend who has stated that he will provide financial support in particulary lodging, food and clothing.
But in my LOE i never stated that he will offer me to stay at his house.

what so you think guys for this notes from VO?
Did he really study my application? I don’t think so, since he closed application within 3 days.
I have submitted at 6/7, he refused at 10/7.

Some of those comments are, in my opinion, unreasonable. If you have money for judicial review, I would challenge the refusal. If not, I would advise you to re-apply alone, not with family at this time. You can invite your family later on.

I have though before to appeal the case, but it will take more than 6 months, and I would miss Janary intake.

Your gcms notes says the visa officer is not certain that you will leave Canada at the end of your stay period, which is why your permit was denied. If there is truth to that, then the visa officer's decision is reasonable.

Jus apply alone then when you get the permit later they can join you.. Since you leaving your family behind will serve as Ties to your home country

How do you know what another person will do in the next one year/ That is totally subjective assessment that does not stand any legal test; it is unreasonable for a VO to think that way. You must be able to prove convincingly that he will not return after his studies, either by showing that there was a country he visited before and overstayed his visa or something like that. These types of reasons don't stand a chance before a judge of the FC. You must have other valid reasons to deny, not a subjective assessmsment.

I don't need to know anything. I don't make the decision. The visa officers are experienced in verifying application documents. They have lawyers and accountants to look over the documents. If you want the reasons, apply for gcms notes.

If you think you're unfairly denied a study permit, file a lawsuit against them

Hi

@tapperb ur suggestion is requested,

I am planning to study in Canada LLM(Masters) or any Law related Graduate program. I have done my Bachelors in Engineering in 2004 and i have 11 years of Work exp into Software. I resigned my job and joined LLB (Bachelors) in India. Now i am in Final year. Do i have any chance to get student visa for doing LLM or any law related graduate program. or only MBA will be suitable. I have also applied for SINP and my score is 63, as my score is low i am planning for study permit. Will Visa officer consider my application by not taking into account of PR application. Is there any mismatch of course if i select Law. Please advice as this has great impact on my career.
