Hey guys,

My girlfriend never got her work permit renewed or extended and we had submitted the application about 8 months ago and her work permit expired a few months ago. I had applied for a family sponsorship, and it required us to submit IMM5710E and we checked marked "Restore my status as a worker" and "Apply for a work permit for the first time with a new employer". So on the document checklist this application was mandatory from what I recall. The document checklist (imm5589e) Section 3 it says which fee I would have to pay which is for Right of Permanent Residence Fees, which I paid for the $1049 for. And under section 5. Class of Application is where we checked mark we were adding an Open Work Permit.

Was there a fee I had to pay for the permit? because I didn't see anything on any of the documents and I even just recently double checked if there was any extra fees that I was suppose to pay and there isn't. I did send a web form seeing further assistance with that and hoping to get a reply.

We are currently at 73% completion for the sponsorship

Main Questions:

1. Can she still drive even though her work permit says "expired" but we have our sponsorship still pending?
2. Is there an extra fee I was suppose to pay for?
3. If our sponsorship fails, her work permit would still be valid (if immigration would allow human error and let us pay for the fee and process her application)

Yes mistakes were made but its our own fault really for doing it ourselves.

Any advice would be great!

The OWP fees are $255. The OWP is generally issued around the 4 month mark. If you applied 8 months ago and haven't received the OWP, it is very possible that it was returned, possibly for the lack of fee payment. If is was, she is out of status now. Also, the "Restore my status" option is for people in Canada illegally, so it didn't apply to her.

So there is a fee that I missed then huh. But nothing was returned or said at all.

The fact that it has been 8 months and no response on the OWP would indicate that it was returned or something else went wrong with the app. You should send a Webform.

Being able to keep working on Implied Status depends on the OWP app, not the sponsorship app.

Okay thanks for the advice, I've already submitted a webform so hopefully they respond asap.
