Help with Common-Law Family Sponsorship

Hey guys,

I am looking to sponsor my girlfriend for a common law PR sponsorship in Canada. I am a Canadian citizen but planning to move to the US for work.

In the official government website, it says "if you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when your sponsored relative becomes a permanent resident."

This would be a problem as I may be moving to US soon for work. What type of proof does the government look for in the plan? How do they even verify this? If someone could share their experience, that would be much appreciated!

You would have to prove the intent that you will be living in Canada after PR - I had one similar application for one of my client. We provided his business contracts as he was self employed and we provided the outline about how the applicant will be living in Canada after getting PR.
Provide them with any correspondence you have with your family members talking about settling in Canada after your girlfriend granted PR. If you have any family/work/realeastate ties to Canada that would help alot.

If I am moving to the US and will be separated from my gf for a few months, can we still apply for common law PR?

Yes if you lived together for 1 continuous year. CIC has become very picky on documentation you will be returning to Canada. Things like proof that you have put in notice for your US job, you have found a job in Canada or have had interviews in Canada, your lease is up in the US, etc. Many people were not returning to Canada so now most people are asked for more proof of intent to return late in their application.

You are actually required to inform IRCC if you move to the US. That has a material effect on the PR app, so failure to do so is immigration fraud.
