1. If you are found ineligible to sponsor, indicate whether you want:

a) to withdraw your sponsorship
b) to proceed with the application for permanent residence

My husband is living in US and planning to move back to Canada. He applied to Master program, still waiting for the result.

Since he is living outside Canada, still waiting for the school acceptance result, won’t be working in a few years if he gets in (His dad will support us if anything happened, we explained on the letter, and we also have saving). Should we tick A or B for the question?

No one can really tell you which to choose, but if it helps: if you choose to withdraw if your sponsor is ineligible, you'll be refunded everything except the sponsorship application fee and cannot appeal the decision, but if you choose to continue you get no refund because they proceed with processing and will likely be denied (having an eligible sponsor is a requirement for admissibility as part of the family class, so if your sponsor is deemed ineligible then you will be deemed inadmissible as a permanent residence) BUT you have the option to appeal IRCC's decision.

The choice only really matters if you think your sponsor will be denied. If you're confident they meet all the requirements described here then you'll be fine, but if not, decide whether you want the ability to appeal their decision and make your choice based on that.

Always select withdraw. The ONLY reason to select proceed is if you know you don't qualify as a sponsor but will be requesting consideration on H&C grounds. Otherwise, selecting proceed is a definite refusal, as no normal app can be approved without a sponsor.

I've already submitted my application Inland and selected the option to continue. We didn't think that there are any serious reasons for the Sponsor not get approved or even check if anyone had questions about what Option to choose A or B. Now my paranoia is back... My question is 1) whether I can make any changes now? 2) do we get any notice if sponsor approved or denied ahead before CIC starts processing? 3) if they do notify in advance, can we ask to withdraw the application, then resubmit it again?

Sponsor approval is part of the processing, so you will be notified if your sponsor is not approved. You can always withdraw your application at any point before you land.

Check the link in my previous comment for the eligibility requirements for sponsors. As long as your sponsor meets all of those requirements, theres no reason to worry.

Thank you for the reply. All I need now is to hope that everything is fine. Do you know whether in case of withdrawal I'll get a refund for the rest of processing, so I can apply again or I'll have to pay again? And if all the documents will be returned? Otherwise I don't know why wouldn't be Sponsor approved.

They would refund the RPRF (right of permanent residence fee, $490) but if they start to process your permanent residence application before you withdraw, then they can't refund that fee ($475) or the sponsor application fee ($75). I believe your documents are returned if you withdraw, but I'm not 100% sure on that.

It's easy to get anxious about this process when you're not hearing anything or seeing any progress for long periods, but usually the less you hear from IRCC the better. Best of luck, try not to worry too much!

Thank you for the reply. I googled it, the appeal usually take a year which is kinda long. I think we better choose A, if we got denied, it’s better for him to get a job in canada and study later.

Yea, don’t think choosing to study can be considered as the H&C grounds...
