Hi All,

I had created my EE profile in Dec 2018 and at that time I was having my FSWP score as 67 and my birth date is June 3. I received the ITA on June 25,2019 i.e after my birthday so my points fall to 66.

I got the nomination from BC on June 23, 2019 and I applied via EE profile and I got the ITA on June 25, 2019.

Now, I'm still in the process to file the eAPR but I'm very much confused now because my scores are less than the eligibility i.e. 67 in FSWP but my CRS are well above the cut off points because of the nomination.

My question is, whether the 66 points impact my application as ineligible or my CRS points are fine to pursue my PR application!

Let me know if you need more info from me.

Thank you.

The 67 point threshold is for eligibility for Federal Skilled Worker program. The CRS cut-off is for selection once one’s in the FSW applicant pool. It’s a two-step process. Passing the 67 threshold is the first step and a must. When application is processed, IRCC will manually verify that the applicant meets both the 67 point threshold and the CRS cut-off.

The following is not a legal advice, however I would like to let you feel better.

If you checked myimmitracker.com, you will notice that some applications were refused after 4x days, some of them for pcc. So, I believe that they already checked your PCC long time ago.

Again this is not a legal advice.

If they reject the applicatin, can I reapply? Do they ban for 5 year? I do not done anything wrong and provided any forge documents. This is a mistake done in unusual circumstances.

If they reject your application in this case, the reason would be (incomplete application) and you can apply later. Anyway don't worry, I believe your application is save, and you might get your golden email soon.

Relax, and don't do further actions to your application until you get a legal answer from some experts.

For the PCCs, IRCC states:

  • For the applicant’s current country of residence, the police certificate must have been issued no more than 6 months before the submission of the e-APR.
  • For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant stayed in that country for 6 months or more in a row.
  • Police certificates meeting the above requirements can be accepted even if they have an expiry date that has passed.
  • This includes the requirement to provide a police certificate for countries in which the individual has travelled for 6 months or more in a row, whether or not the individual had an established residential address during this time.
Since you relocated to a different country, and you are sending the PCCs via CSE, you will be fine.

Dear mbaleine, does it mean I'm safe for both the thresholds or I still have to worry for 67 points?

Thank you very much @legalfalcon! Appreciated! Will expedite the process of getting updated PCC and raising the CSE.

Your age used for calculation purpose is frozen on the date of ITA. Given that your ITA happened after your birthday, based on what you described, it sounded like you would have had 66 points, which would make you ineligible.

What seems to be strange, however, is that you received ITA at all, give that the draw happened after your birthday took place (because if like you said your points indeed dropped to 66, then your EE profile would have become ineligible and there wouldn’t be an invitation at all). Are you absolutely certain that on the day you received ITA you had 66 points instead of 67? Because the system sure seemed to have thought that you had 67.
