Student Visa Refused (Urgent Help)

Hello,

I applied and was accepted to The University of Toronto and ran into some issues. I was recently submitted my application for my visa and I was refused. I showed more than enough financial proof and support as well as filled out all the requirements. I am a current DACA resident in the United States, which I knew would be an issue if I was applying abroad. I applied for my study visa with full documentation and was refused on the basis of:


"I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on your immigration status.
I am not satisfied that you will leave Canada at the end of your stay, as stipulated in subsection 216(1) of the IRPR, based on the purpose of your visit."

This might be a stretch of a question or an inquiry for off ability, but what steps can I take next to reapply and strengthen my changes of obtaining my visa?

My Uncle is financially supporting me. He has land and property in Kenya, which is where my citizenship and passport are from. I also have all my extended family in Kenya and India - leaving only my parents in America. Would it be enough to show the property and assets in Kenya and convince the officer that I plan on moving to Kenya after my studies to help my family? Would flying to Kenya and applying from there help my case? What can I do to prove I would leave Canada after my studies?

This seems like a very tough situation, what did you write in your study plan?

You probably need to actually live, get a job & form some sort of strong roots in Kenya, which doesnt seem like a realistic solution.

Your uncles property & land dont mean much to IRCC as you are not going to return to Kenya after graduating because of your uncles property.

I am currently writing my letter of explanation;


"Leaving Canada at the end on the Purpose of the Stay:
I have been admitted in to the top institution in Canada, The University of Toronto, and am planning to pursue Social Sciences under the program for Society, Ethics, and Law. This school, as well as the program itself, is seen as rigorous and requires the student to be at the prestigious level competition among other enrolled students.
The purpose of my visit is to solely study under the esteemed university. Due to the evident rigor and prestige the university presents, the purpose for my stay is to maintain the highest level of accomplishment and studies necessary for success in my course and program. I have no relations tied in Canada, nor do I plan on encouraging family or inviting any direct or extended family members in to the country. My intentions for applying to The University of Toronto is because of the prestigious and established reputation of the university. The university is known to produce the top graduating alumni in multiple fields and is seen as the top university outside of The United States.
To further outline my purpose of studying in Canada, I have attached the receipt for enrollment deposit as a means to provide evidence of my enrollment and confirmation into the university."

I currently hold a Kenyan citizenship and reside in The United States of America under The Dreamers Act, or DACA. My family illegally come to The United States and I was therefore granted the DACA status to continue studies. I have resided in The United States for roughly 13 years.
After finishing my studies at The University of Toronto, I plan on returning to the country of my citizenship, Kenya, not The United States. My family who reside currently in The United States, being my mother and father, will be moving to Kenya in 2021 due to their case file for immigration in The United States closing. I hold strong family connection in Kenya as it is the residence of multiple family members, marked by the attached copies of the identification cards held by my close family relatives. By the end of my studies, a majority of my close family will be located in Kenya, being the only liable location to return to. I have finances and property as displayed through my family and plan on residing in Kenya to support my family full-time after achieving my degree. My family is dependent on my education and career as I return to Kenya. I hold no ties in Canada, nor do I hold any plans for a permanent stay or plans for overstaying my visa."

Oh I am sorry!
You need to write a strong content in "Future plans" in your SOP. You need to show and make them understand that you will be returning back to your home country after completing your studies in Canada.

Denied for the same purpose - not satisfying the immigration lawyer I would leave at the end of my stay due to my immigration status.

You need to write a strong content in "Future plans" in your SOP. You need to show and make them understand that you will be returning back to your home country after completing your studies in Canada.

You can write points that make them feel that yes at the end of your studies you will be leaving Canada!
Make some strong points like your family is the main reason to come back or something like that.

Even i got rejection on the same reason but i was going for my flight training career. It was in professional flight centre, British Columbia. I ordered ciaps and they state the below reason. Please help me with this.

"Client is requesting an initial study permit. Documents submitted do not satisfy me that client have a high degree of establishment in india. Though client appear to have sufficient funds, i am not satisfied that progress of studies make sense , given the distance and cost involved. Not satisfied that client is a genuine temporary residence who will leave canada at the end of stay. Application refused on basis of R216. "

What does this mean is it a college problem or showing strong ties with india?

Unfortunately whoever encouraged you to apply to aCanadian university didn’t realize that you were never going to be accepted due to your lack of longterm status in Canada.

And the fact there are loads of recoqnized flight training centres all around Asia and Australia. Why would coming to Canada for that be a necessity.

No but budget is also an issue......There are many in india but the prices gets upto 80-90 lacs wherein canada it is nearly 50-60 lacs with advance training.

Canada has best training review and it is cheap thats why i selected canada.

But refusal is due to unable in showing strong ties with india and not showed funds in large amount though we have much.

What does this mean is it a college problem or showing strong ties with india?

According to me they are not convinced that you have done higher studies in India. Did you submit your Provisional Certificate of college?
And yes they are also not sure that you will be returning back!

But bro......why would i do higher studies because for this course only 12th science in PCM is required, which i have secured with 71% marks. So i dont think that this will be a problem.

Did you submit all your marksheets?
