And to be approved in principle it happens in the end of the process time? I have 9 months left until the 12 month mark of my PR application... Ok I will send restoration application and send it, do you happen to have direct link to the restoration application? I'm just afraid to do another mistake now, thanks for the help , I really appreciate it .

Don't worry my friend, it's better to know the sad truth than to remain in ignorance :) thanks for the link, one more thing, as I read in the link you sent me, they say that if the person is refused the restoration they should leave Canada immediately, would that happen to me even if I'm under the PR application? That's scary.

Nothing, because you applied inland. This would be the case in most situations where you were denied restoration since you'd be out of status - in other words, you'd be in Canada illegally. However, one benefit of the inland application is that you actually do not need to be in status throughout processing (see below). I would encourage you to work on the restoration app and call tomorrow to confirm.

3. Policy
CIC is committed to family reunification and facilitating processing in cases of genuine spouses and common-law partners already living together in Canada. CIC is also committed to preventing the hardship resulting from the separation of spouses and common-law partners together in Canada, where possible.

This means that spouses or common-law partners in Canada, regardless of their immigration status, are now able to apply for permanent residence from within Canada in accordance with the same criteria as members of the Spouse or Common-law Partner in Canada class.

Oh I see, that's good! I just checked the fees of the restoration application and this is what is listed:

Processing and collection of the fee: $200 per individual

  • $200 for visitors;
  • $350 for applicants who also require a study permit ($200 for the Restoration of temporary resident status processing fee and $150 for the study permit); and
  • $355 for applicants who also require a work permit ($200 for the Restoration of temporary resident status processing fee and $155 for the work permit).
Now since I already covered the 155$ and the 100$ when I applied for work permit, does that mean I also need to pay the 200$ for restoration or one of them will be paid twice?

I believe it's $200 but may want to call and ask tomorrow - sorry, I can't answer that one definitively and do not want to lead you astray.

I still couldn't find the application form for restoration? I think I'm getting all stressed out, I'm sorry for keeping you busy with me here, would love to get you a beer some day :)

UPDATE:

I've just finished my call with IRCC and I explained my situation, they have told me that in my case they will only start processing my work permit application once I get approved in principle, I asked if I can correct this by applying for restoration of status application, they told me no, it will not change the situation and I will still have to wait until I get approved in principle. I asked if there is anything I could do to get the work permit faster by correcting my status etc.. she told me no. Also I asked how much will it take after approved in principle to process work permit, she said that she doesn't know.

I really don't know, it is weird, I kept repeating the same question that if I apply for restoration of status wouldn't it help with the work permit, she told me no and you don't need to apply for restoration of status. My problem is that she didn't ask me about my application number nor UCI number to relate to my case, it seems these are automated answers that they say to people in such cases.

Sucks, there's a chance they will take the restoration and a chance they won't, it will be up to you. AIP comes at the end of the process so you'll have a bit of a wait ahead of you.

You have nothing to lose, If I were you I will go with the request of restoration, you have only 90 days to restore your status, then as @kcward7 was saying you still have a chance to get OWP if there is an angel over there.

I think I will apply for restoration nevertheless and give it a shot. But at the same time won't be waiting for a work permit and develop any high hopes for the near time.
