A friend got rejected for PR because the officer was not satisfied with his reference letter matching the NOC code he chose (NOC 1215). The letter was written by the HR with the Area Manager's edits. BTW the AM does not directly supervise him, so he felt he overstated his duties. He met an immigration officer who advised him not to reapply as his application may come under major scrutiny this time around.
He thinks he can get a better letter from his direct supervisor that will more likely align with his NOC code but here are the concerns:
1) Would CIC be concerned that the letter is signed by a different person this time around?
No. The responsibilities should match the responsibilities listed under the NOC, irrespective of who issues the letter. In your case, I suspect the majority of the responsibilities might not have matched the ones on the NOC. While there is no hard and fast rule, ensure that at least 70-75% of the responsibilities match the ones listed on the NOC.
2) NOC 1215 includes supervisory positions. Will CIC wonder why it is being signed by a supervisor which the could consider as a colleague?
As long as it is signed by a 'competent authority', I believe it should be good. I would strongly recommend to get the letter notarized if the it is not on the letterhead.
3) Can he reapply with a LoE stating why the initial letter was unsatisfactory? Will this raise misrepresentation issue?
Nope, I wouldn't do that. Just reapply - you don't have to talk about your previous rejection in a LOE. However, he has to disclose this refusal in the statutory questions section of the eAPR.
4) The previous letter had his job title as 'Warehouse Worker.' Can he use the new title as 'Operations Specialist?"
He should have the means to back that up in case the officer wants to dig deep. The title really doesn't matter as much as the roles AFAIK. What matters are the responsibilities on the letter that match the responsibilities under the NOC.
5) He plans to extend his PGWP for the remaining 3 months CIC owes him. Can he flagpole for that?
I'm not sure about this one, I'll let others answer this one.
