Common-law partner sponsorship, newly divorced

Hi,

I want to sponsor my common-law partner in-land.
We have been in a relation for 7 years now.
He is physically separated for 4 years now from his legal spouse.
He has been through a divorce procedure for 2 and a half years now.

My question :

Do we have more chances if my sponsored common-law partner agrees with his legal spouse to get an agreement on the divorce? The documents will show that he is newly divorced, so can this support our application?

As long as he can shown that he is separated and that you guys are common-law, the app will not be treated any differently than if he gets divorced.
