Hello friends! I am new to here. I came here in Canada since 2012 as a visitor I am renewing my visa every 6months until 2016 of February got denied for extension. Luckily I married a man who is Canadian citizen. I applied for my PR app September 6.2018 , they received my app oct 15 2018 got my AOR November 1 2018... and I applied for renewal passport.
And my questions is since I am out of status are they going to send me back home even though my PRapp is on processing?

Hi.
According to their policy, you're allowed to stay in the country while you're application is in process, in case it gets denied, then you could be facing a removal order.

Now, there's a probability that CBSA can get a hold of you and give you an exclusion order, which would be in effect if you're application gets denied.

This is my experience as I have also been out of Status, longer than you and have been dealing with CBSA.

I'd say, if you have submitted a very good application, you can sit back and relax!

My wife was much like you, here on valid visitor status for several years before being denied a further extension, was out of status here for over 2 years, she was granted PR just over 3 months ago.

She never got onto the CBSA radar which was a huge relief when she finally landed, so many years of stressful living behind us.

Only thing I would say is if you met your sponsor and got married after you fell out of status then your app may face extra scrutiny.

Yes, mine was received on July 25th 2017, dealing with CBSA since February 2018. So far, haven't heard anything back. Almost 16 months.

I apply for common law after being out of status 3 years ! My application was received on April 2018 I got AOR medical request and they receive it and nothing since then. I’m not married but I’m being living with my fiancé (just got engaged) for 2 years. When I send my application we was only a couple. We already have plans for the wedding on October 2019, so I hope I get my PR till then. If is a real relationship I don’t think that you need to worrie to much.

That pretty cool. My situation maybe different yours. It’s same sex marriage.
That doesn't make any difference, same sex couples are treated the same way opposite sex ones are. You don't have to worry you'll be sent back based on that or anything.

How about the background check? They do it after u send your application? Bcoz my husband is not working right now he got fired from work. I hope doesn’t affect the application

The background check happens in the second half of the process. It starts after the medical exam is done.

There's no financial minimum for spousal sponsorship without dependent children. As long as your husband is not on welfare, you will be okay (you might have to explain how you plan to support yourselves, but that's the extent of it).
