PR card approved but was told to pick up in person?

Hi friends,

My pr card renewal was approved but received email from IRCC to pick it up in person. There's a big problem now.

As of today I am short of 90 days to meet the RO. In other words If I count days backwards(5 years) from today I am around 1 year 9 months living in Canada.

What are the chances of prtd approval if I apply the prtd within a week given the fact that my card was approved?

This is a real pain now.

If you are are do you have a valid US visa??

No, I don't have a US visa and was rejected US visa several times, so I don't think it's a option.
If that is the case then your only option is to apply for a PRTD to come back.....
Whether you will be given one depends on your specific case, that it, the reason why you have failed to meet your Residency Obligation.....

Hi, I don't have any valid humanitarian and compassionate ground. what happens in this case? Is this a easy denial?

Honestly, having had your PR card application go through secondary review already, I would say there is probably a pretty good chance the will review the RO. Since there seems to be no other option for you but to apply for a PRTD, I would do it as soon as possible. You will want a response as soon as possible, so you can take advantage of having been in Canada in the past year “IF” (and it really is a big if) they do start the process to revoke your status. Having been in Canada until September last year (based on your previous posts), it entitles you to a PRTD if they do start the process to revoke your PR and you appeal.

It really is a crap shoot...they may just process the application and provide a PRTD, or they may dig deeper. 6 of one, half a dozen of the other. But a PRTD seems to be your only option at this point, and the longer you wait, the more likely someone will review residency.

ya I am about to apply for a prtd asap. Let's see how it goes. I think they also see that I am going to Canada to pick up the renewed pr card. Do you think picking up pr card makes sense to them and is somewhat to be considered a good ground to allow prtd?

It’s certainly a reasonable reason to apply for a PRTD. The question will be whether they decide to review residency at the same time or just issue the PRTD. It will all depend o. The visa officer assigned.

You were asked to apply for a PRTD because they want to see if you have a reason to keep your PR

Don’t be fooled by them saying to pick up the card... it is all procedural....

ENF 27 section 7.3 and 8.5 ....require that an applicant who is out of the country be told to apply for a PRTD so that a residency determination can be made and if any H&C reasons to be put forward so that they can be evaluated.....

If u have no valid H&C grounds, unfortunately, then the PRTD will be denied then the process to revoke PR status begins.....

You are still required to meet the RO to qualify for the PRTD, regardless of the PR card being renewed. I would imagine it will be refused and as you have no H&C grounds, they will begin proceedings to revoke your status.

If OP has been in Canada for at least a day in the past 365 days their application for a PRTD on H&C grounds will be denied.....
However one will be issued do they decide to appeal the decision

I don't believe that this is the case in this specific instance. The requirement to pick up a renewed PR card in person is fairly routine for applicants who apply from outside Canada. The need for a PRTD and resulting residency examination just seems be a happy coincidence, as the OP doesn't hold a valid PR card at the moment.

There WILL be a residency obligation examination as part of the PRTD process. It's extremely likely that the OP will be denied as a result.

A residency obligation examination is done as part of any PR TD. If you are found in violation of the RO with no H&C reasons, I don't see any way a visa officer would approve the PR TD. My guess is the most likely scenario here is PR TD is rejected and process started to terminate your PR status.

Of course you may as well try since it's your only chance to get back to Canada. Who knows you may get lucky... but I would suggest you have a good back-up plan (i.e. if you will decide to appeal should the PR TD be rejected).

If OP has been in Canada for at least 1 day in the last 365 days...even if they are denied a PRTD on H&C grounds... then they can be issued one if they intimate to the Consular officer that they wish to appeal the decision....
