Yes. Absolutely true. And in my case they rejected it after 60 days after I uploaded all docs. But if the mistake is theirs and he can prove it, then there s no other option for them but to reopen!!
They should cancel everyone who has incomplete app. in the first month yes, but unfortuntely its 55-60 days for most.
I have shared them a couple of posts above this post. My dtream is Federal Skilled Worker, express entryOP, would you mind sharing your timelines? Like AOR, Meds passed and the stream to which you belong to?
I don't want to worry you but after I have seen my case cancelled for their own problem, I believe everything is possible in this system.@farazafzal - I too have recently raised a CSE as by mistake in my Marriage certificate documents I attached scan of Affidavit of translator for 'Birth Certificate' instead of Affidavit of Translator for 'Marriage certificate'. They are the same person from same Translation office and the appearance of the document was the same and I made a mistake during scanning and sadly I noticed only after uploading and transmitting. I raised a CSE and explained the situation and uploaded the corrected documents.
However- after reading your posts above please note the following:
- I have NOT attached a scan of the Original Marriage Certificate.
I have uploaded only the following:
- Colour Scan of Certified copy of 'Nikah Nama' (Marriage certificate in Urdu) with stamps of Notary Public notarizing it to take effect on all continents and stamp declaring "Certified True Copy of Marriage Certificate"
-- The Translation of the certificate by a certified Translator from Translation office - I had it also notarized by the same Notary who notarized my Certified True copy.
-- Affidavit of the translator - notarized by same Notary
-- Affidavit signed by the Notary Public on PKR 100 Stamp paper with his full name address and license as Oath Commissioner/Notary Public declaring that he has certified true copies and notarized them.
Will not uploading the scan of the original marriage certificate be an issue? Could I also have my application cancelled because of this? Very worried now. Kindly advise..
I dont know and I will forward your message to my lawyerIn order to find out where your case is being processed, send the following e-mail to CPC-CTD-Ottawa@cic.gc.ca
You will need to communicate them your application number!
Subject: E000XXXXXX - Visa Office
"Hello,
I am trying to find out in which Visa office my application is being processed?
Application number: E000XXXXXX
Date of Birth: YYYY-MM-DD
Last Name: ...
First Name: .....
UCI: -
Category of Immigration: Federal Skilled Worker
Best regards"
Shortly after you will get an answer. Then contact me if you want, I will direct you further. If you already know where you are being processed, share information here.
You can at least try, of course its not a guarantee it will work, CIC is overloaded AND making silly mistakes.. disturbing I agree but you have to try everything in your power!!!
Happened to others too? Do you know any case has been rejected by mistake and CIC reopened it?Send them a Case Specific Enquiry because if its their mistake, they will reopen your application. Happened to others too.
If you know where your case is being processed, you can contact that Visa office directly through CSE or by mail!
If I'm to take your word for it, it sounds like human error on the IRCC agent's part. It happens, sadly. If you decide to get a new ITA, you can get the chance to write a letter of explanation and ideally get a more forgiving agent.Yes. But as long as I don't know the real reason of rejection, another application might have the same result. REJECTION FOR INCOMPLETENESS. That is why, I am trying to find out what caused them not to see/consider my marriage cert.
Anyway, I am still shocked. I will wait until next week to see if I receive any response from CIC, if not I will re-apply from the first step.If I'm to take your word for it, it sounds like human error on the IRCC agent's part. There's no right or wrong way to go about it, but my suggestion was just if you wanted to speed up the process. Like you mentioned, reopening can take up to a month or more. A new ITA would happen in a week or two.
I think, you uploaded certified 'copies' of the original and did not include the scan of the actual 'original marriage certificate'.For those who asked me for elaboration:
I have uploaded all certified copies of my original documents exactly according to the CIC instruction (notary public certified and so on) + their certified translation (again exactly according to instruction). I have an experienced registered lawyer in Canada doing the job and double checked everything. He's got surprised when the case rejected. He sent a CSE to them however he is not optimistic at all that CIC take the problem serious. We are now looking forward to their answer and likely clarification.
For people who like to know more info about my case:
My total score:457
IELTS: overall 7.5 and R7.5 L8 W7 S.7
Medical: Passed just a couple of days before rejection
I got ITA in January and uploaded my case 40 days after that.
I live in and apply from Iran
My lawyer is in Canada
The rejection reason: incomplete docs
(Original marriage certificate)
Those who may have reliable info please advise. I would appreciate.
Youre right. But they did ask for the certified copy in the checklist. They didnt mention 'The scan of the Original '. Why should we include something that they didnt ask for it? In addition they clearly mentioned the missing "translation " as well!!! If the problem was the Scan of original doc, why they couldnt see the translation?!! If so, what for other documents? We have to attach the scan of original of all docs to the requested docs of the checklist?!!!!I think, you uploaded certified 'copies' of the original and did not include the scan of the actual 'original marriage certificate'.
Please feel free to correct me if I am wrong. And if so, then, I guess, the processing agent got mislead by the certified original and took it as a certified copy of the original. Which you would need to explain clearly if you wish to get your file re-opened.
How many days since AOR you got rejected? Is it under 2 months? For those who asked me for elaboration:

Yes, plenty of them on this forum, I ve read a couple of experiences where the app. was refused because of their mistake.. but it takes a month or more to reopen so I dont know whats the best solution, it can be either way. But with 457 you can get new ITA in no time. If your docs are all correct and you are sure of it then no harm in trying again with the same docs I guess. If you say its their mistake, then its their mistake and shouldnt happen again.Happened to others too? Do you know any case has been rejected by mistake and CIC reopened it?
I included also all the originals for all the documents. And in colour. Although it didnt say so on CIC, because I ve seen a lot of cases like yours where they made a mess because of it.Youre right.
