Hey guys I need a help on this one
I know it’s shouldn’t be in this forum but I need your suggestion asap.
( written by my wife)

Hi Everyone,

I applied for my parent's visitor visa on October 12th. They completed their biometrics on October 15th but I got a visa refusal(on dec 11) for them. I was inviting them for a month because I am pregnant (Due in end of March 2025). I am here on work permit and my husband is a Canadian citizen and my spousal permanent residence application is left with background verification. My parents showed 30,000 cad bank balance and 1.5 million dollars property evaluation signed by Indian CA. They also showed their business and tax returns from last 3 years. My mom is house wife and my dad run two business. This is the refusal message they received.

"I am not satisfied that you will leave Canada at the end of your stay as required by paragraph 179(b) of the IRPR .I am refusing your application because you have not established that you will leave Canada, based on the following factors:

• The purpose of your visit to Canada is not consistent with a temporary stay given the details you have provided in your application.

• Your assets and financial situation are insufficient to support the stated purpose of travel for yourself (and any accompanying family member(s), if applicable)."

Can someone help in figuring what must have gone wrong? I thought inviting them into Canada on parental support during my pregnancy would be a solid reason to get the visa quickly. Any suggestions are appreciated. Thanks!

As far as I have heard in many other cases (this is hearsay but seems logical), if you did actually mention or even indicated that you are inviting parents for support during pregnancy and/or child birth, that alone is enough reason for refusal. That's because this kind of support is considered as caregiver work and work without proper authorization (even if the care is given by parents and is unpaid).

Intention to work in Canada without proper authorization is grounds for refusal.

Try to resubmit the application and reduce the overall period of visitation and try using purpose of travel as either tourism or family visit without any indication that you need support for your pregnancy.

With the new immigration policy on visitor visa issuance, I can not guarantee your previous refusal won't restrict the parents visa on how much time is allowed but you can still try.

This is just my opinion and please don't consider this as legal advice.

We are planning re apply their application and shorten their visit from one month to two weeks and not mentioning any support during the pregnancy. However, can we say they will be here for two weeks to meet their grandkid and go back ? Or
Should I just apply for her mom only rather than both of them ? And we are also showing more ties to their back home ( mentioning their property on their name and six month bank balance (30k cad).

well here you have to choose hard decision . As right now they are refusing a-lot of visitor application. I recommend to apply super visa.
If you can call your husband family for that time of period .

as u already applied on behalf of child care . Thats wrong reason to invite and easy reason of refusal(as that comes as nanny application). In my view if you applied again there will more chances of refusal.

If you’re happy to have just your mom travel I would suggest she apply on her own

We don’t mind doing that either but she doesn't have any bank balance so she has to use her husband bank details
I also heard it’s better chance for them to get visa in couple rather than individual ! I could be wrong though

This is purely my personal take on this, so please take it with a grain of salt ...

If the wife needed her mom/parents in Canada for help during the pregnancy and/or post-partum, then the super visa would have been a better route. Many people don't opt for it due to the money, medical tests, and relatively longer time for approval and so they apply for a visitor visa instead.

If I were you, I would try a super visa application if it is useful at this point in your wife's situation (and possible for your parents with regards to their health), since it seems more appropriate in your case but mention companionship rather than caregiving as the reason - so, "mother wants to spend time with her newborn grandchild" is better than "mother wants to care for her daughter who just gave birth." To you and me, both mean the same thing but the way we put it displays our mindset and intent to the third person (IRCC) who doesn't know us or our parents. Or take a chance with re-applying visitor visa and say they're coming here to visit the country, change of scenery, do some sightseeing as a family since their daughter and son in law live here, and provide a promise to travel back in 6 months or less for some strong reasons back home such as management of property and finances or resuming job/social responsibilities... being truthful of course, along with evidences. I would also try to have the parents apply for the visitor visa themselves instead of you/wife applying for them with these explanations in the application.

On a different note, congratulations on the pregnancy! So sorry her mom isn't able to be here during this vulnerable time. We are trying to start the journey you are on and even for that we feel the need for parental support and wisdom. This phase of life is not an easy ride; I wish you both the best.

Yes, it's correcting a glitch with the French translation. If you look at the French version of your original SA, you'll see there's a part that's in English, followed by "_fr".
