I have a query regarding PCC asked by IRCC with regards to Citizenship Application. Situation is as follows: Re-entered Canada on Dec/31/2020 (was already a landed PR on that date). Applied for Citizenship on Aug/21/2024. Have been in Canada since Dec/31/2020 and have not travelled out of Canada not even for a single day. My understanding is that if the situation is that "a total of 183 days or more during the four (4) years immediately before the date of your application" if a person is in a country(s) other than Canada then need to provide PCC from that country(s). In this situation I was in India for about 133-135 days (less than 183 days) during the four (4) years immediately before the date of citizenship application i.e., between Aug/20/2020 to Dec/30/2020. Now I have been asked by IRCC after I have passed the Citizenship Test to submit PCC issued after Dec/31/2020 within 30 days. We had applied two separate application: One for myself and son and another for wife and daughter (both have different application numbers) and this query has been raised just for me whereas the dates for all are identical. My question is that can I write to IRCC explaining the foregoing that as per the requirements I was less than 183 days in an another country in the last 4 years from the date of the application plus since the passport has expired the agency responsible for issuance of PCC is insisting that I need to first renew my passport to be eligible to apply for PCC, which again is an undesirable and unwanted exercise and expense + time consuming and if I undergo renewal of passport and then apply for PCC it will not be possible at all within 30 days to send PCC to IRCC. What can be the pros and cons if I write to IRCC explaining the foregoing and seeking waiver of the requirement of PCC to both the applications ? Can they waive this requirement if the above case is made out ? Thanks in advance in anticipation of your cooperation.
