Hello everyone! Can anyone please give me an advice, what are my options if I can't get any documents or information from my dependent child (she's 21, living in Germany and we don't have the best relationship).
My application was returned and I should provide info regarding my non-accompanying child from previous marriage.
I'm applying under spousal class, living and married to my sponsor - wife.

Hi guys!
I am an Indian citizen and went to the UK to study for my bachelor’s degree. While in the UK, I came to Canada as an exchange student. After arriving in Canada, I decided not to return to the UK. I sought advice from a lawyer, and they suggested I apply for refugee status by claiming to be gay, stating that this would allow me to obtain permanent residency within 2–4 years.
I filed my refugee claim in May 2024 and received my work permit on July 11, 2024, valid for two years until July 11, 2025. In November 2024, I met my girlfriend, who is a Canadian citizen. She is also the daughter of my landlord and, like me, is of Indian origin. Recently, she offered to sponsor me for permanent residency if I wanted her to.

However, I am unsure whether I should proceed with marrying her. Even if I apply for PR through spousal sponsorship, I am concerned that my refugee case might be heard before my spousal application is processed. If this happens, the authorities may discover that I lied about my sexuality in my refugee claim. I am very confused about what I should do next.
Could someone please suggest what the best option for me might be?
Yes, this situation is very problematic for many reasons. The basis of your refugee claim is one issue. The second is that you seem to have only started dating your girlfriend this month so that is going to look like a marriage / relationship of convenience. Talk to a very good lawyer before you file for anything else. Also note that you would need to be either married or common law in order for her to qualify to sponsor you.

If you did in fact lie about your sexuality in your refugee application, that would mean you committed misrepresentation and this is extremely problematic for your future in Canada.

I wonder if the confusion you’re feeling is just the feeling you get when you know what is the right thing to do, you aren’t doing it, and you’re struggling with rationalizations that try to do the impossible — turn a wrong into a right.

I can’t imagine a lawyer gave you that advice. I’m not a lawyer but it sure seems like you committed fraud upon the crown.

I’ll bet the proper advice is the same the IRCC always gives: be honest. You’re just not going to love the consequences in doing so now.

@vetikati

Firstly, if a lawyer suggested this to you...report them to authorities. You can do it anonymously.

Secondly, cancel your refugee claim and return back. If you want to live in Canada, you'll have to return. If you don't, IRCC will find out. Cuz you are not the only one. Just do a search on this forum with "gay, same sex marriage, asylum" and see how many of those posts are from Indians. IRCC knows this fully and they are rejecting those applications. Cancel your application right away. Return to home.

Your gf can sponsor you on Spousal PR. Yes, you may have to live in India for a year or two (hopefully it's not that bad there...is it?), send then you can return permanently and legally.

All the best.

He doesn’t need to have worked for a year, there’s no minimum bank balance and, sadly, no one knows how long it will take but it could be quicker than the current processing time of 10 months. Please review the official requirements on eligibility here

Beyaza Kiz Kardesim - If your yengay is Canadian Citizen or PR - there is no such requirement. As long as he is Canadian Citizen (check his passport) or PR (then PR card) - there is NO SUCH REQUIREMENT. For Spousal PR application, there is no requirement of certain amount of bank balance as well. Though its common sense, that he will need to provide his letter of employment and salary pay stubs to prove that he can take care of your financial and living expenses.

Go ahead with your marriage - and while taking all the steps keep copies of emails/watsapp messages and pictures of every event. You will be required to provide all of this to prove your marriage IS GENUINE - AND NOT FOR THE PURPOSES OF GETTING CANADIAN PR.

Please take your time to go through the Spousal PR application guide - which the person above has provided you. Just go through it once, at least, so that you are aware of each requirement and you can organize each document & evidence which will be useful for your Spousal PR application later.

Lastly, if you are working or getting any education, please dont abandon it right after marriage. Spousal PR applications are taking time these days. The 10 month guideline is very much MIS-INFORMATION BY IRCC - its only for very selective applicants and favorite Nationalities - not everyone. If your application happens quickly - very good - chances are it will take time - atleast 15 months.

Invest that time in yourself and getting ready to hit the land running - when you finally land in Canada.

Congrats and wishing you the very best.

Is it 10 months yet? Then why do want to be in 'worry-mode'? Chillax- till January. Then go in worry mode. In the mean time - order your GCMS notes so that you will get it around first week of January. You will have some idea of where it might be stuck, if its still stuck by then.

I do recall that last year when filling these forms, i simply typed in the full name. However, i guess only the Representative form where the principal applicant/Sponsor/Representative has to do the 'wet signature' .

Have you checked the guides for each form?
