I have a CBSA warrant and my passport is being held due to a failed refugee claim. Now that I've received an eligibility letter from IRCC for my spousal application, what steps can I take to regain my passport and have the warrant lifted?

You'll probably have to turn yourself in and go from there.

You won't be able to get your passport back until you have PR.

Hello,

All you have to do is pop into the CBSA office that generated the warrant and they'll be the ones who will help you out.

Okay thanks again. I just don’t wanna get arrested and detained again. I did before for one week and that wasn’t very demure of them but thankfully I got bail and got to sort out my stuff now I’m ready to lift the warrant and start integrating back into society properly.

You should be working with a lawyer. If you are working with a lawyer: ask the lawyer.

This is serious enough that you should probably NOT take advice from a public board without checking with a professional.

Occasionally, legal services may be unnecessary, as individuals can handle certain matters themselves. I speak from experience, having previously relied heavily on lawyers and accumulated over $34,000 in fees over seven years. Not all immigration issues require legal representation. Although it may seem counterintuitive, I've navigated worse situations and can attest that some matters don't necessitate professional assistance. I'm seeking insight into the CBSA's 'catch and release' procedure for individuals with approval despite having an active warrant. While I have some knowledge, I'd appreciate additional perspectives from those familiar with this process.

Damn oh okay, when you say then myself in you mean I’m gonna be locked up & arrested or just do paperwork and leave ?
It's hard for any of us to answer that question without knowing your full history / profile. Just make sure you haven't skipped any meetings with CBSA or IRCC and attend any meetings if you are asked.

I’ve already passed those stages, never missed any meetings etc but thanks for the advice.

I don't believe I suggested using legal representation for all cases. Just for yours.
