Registering a foreign marriage in Canada

Hello,

I got married outside of Canada and my spouse isn't here yet. If my marriage certificate from a foreign country is valid, then does that mean that my spouse is also bound to family law in Canada? I want to know, because I may have a case of financial abuse against my spouse.
I suggest you see a lawyer, how family law would apply in a particular case is not something for which you shoudl rely on an immigration forum. In general, a married couple living in Canada - regardless of where they are married - would be subject to the relevant provincial provisions. But that's too general a comment to be meaningful in a specific case.

I was married here in Philippines with my pilipino Canadian citizen husband ,our marriage is undeclared in canada.and I found that he has an affair with other woman in Canada and thinking to file a divorce for the intention of remarry other woman. Is it possible for him to file a divorce since our marriage is undeclared? And what should I do to make my marriage declare in Canada.. can I declare it on my own like going to embassy and submit all the documents I have?

Pls do help me or advice me what to do

-If he is resident in Canada, then yes, he can initiate a divorce from Canada. There is no 'declare a marriage in Canada' process. It is a bit more complicated for him to finalize a divorce in Canada if you are not present in canada, but there is a process.

As for the rest of your questions: what is it you want / want to do exactly?

Hi, my husband and i got married in Africa our home country and it was court marriage, we intend to do a religious wedding here as we didn't get the chance to do if back home. that will result in us having two marriage certificate is that allowed ?

No, you can't have a second civil marriage in Canada. But you can have a (legally meaningless) religious marriage if your religious organization will perform one without the civil part - you must be specific with them about this, you only want the religious ceremony (because already legally married).

Background: in Canada marriages are mostly performed by individuals (eg religious leaders) as agents of the government (sort of like being deputized). They can perform whatever ceremony they like (or that the church or religion allows), and they carry out the civil functions (registering marriage, witnesses signing docs) as part fo the process (usually quietly and separately but depends).

Large organized churches (eg Catholics, Anglicans, etc) have specific rules on what their ministers are allowed to do (what types of ceremonies, where, minimum requirements, etc) and call weddings or marriages. If they will not /cannot perform just a religious marriage without the civil part, they may offer something like a 'blessing of union' or some other name.

In other words, ask your religious leader/community what is possible.
