Hello Dear, thank you for your reply.
This is correct as per IRCC guidelines that the status of one parent is required, however, some school might ask for a study permit even then. I will check with the intended school in this case, if they require a study permit, I will apply post-reaching Canada as the application filled from within Canada processes much faster.

But assuming the school does not ask for study permit, and accept my kid to school, she will be on a visit visa (valid for 6 months only/per stay).
1. Does this mean that she will have to exit every 6 months and re-enter to continue her studies?
2. Or IRCC/border officer can give her a study permit which will be valid as per my student visa?

Pls advice.

Oh is it? You mean on a student visa she also received an open work permit and the kid was on a visitor visa and received a study permit?

Is this correct understanding?
No spouse came on SOWP. You will know once you try and enrol your child. Why don’t you ask the school board before you land? A quick phone call will tell you.

Unless you are not going to BC, I cant speak of other province. All SDs board are provincially regularated, they dont set up admission rule different from other Cities. There is clear policy for Ministry Funding that set up eligibility criteria.
There are also sanctuary city, New WesMinister for example does not share any records for undocumented to the Feds

We have seen previous examples on this forum where students have been asked to obtain a study permit. It can vary by board. Many also get denied TRVs by IRCC and told to apply for a study permit instead. Even though TRV should be sufficient in practically it is not longer enough in many cases. Much safer to apply for study permit.

You need to be very specific with “ i have seen previous examples” in relation yo BC school enrollment for minor….. Stop speculating, there are guidelines in place in BC

Im sure you know the difference between undocumented/out of status and those with valid visitors status but not study permit. So City of New West decided to accomodate all minors regardless of their status

I understand that but that is a perfect example of how there is variability between school boards.

The search engine in this forum is awful so I will not spend hours trying to find the examples. There is a lot of newcomers and visitors who come to especially the Vancouver area. Many are under the false impression that since Canadian students do not pay tuition and students who are eligible for public school at no cost that means that public school is free for anyone wishing to attend a public school. Proof that a parent is working or studying can be easily falsified or manipulated so that is one of the reasons that many schools or school boards now ask for study permits to verify that the specific child is eligible to attend school. There is a lot of inconsistency in the system and even depending on who you deal with. There is also a large international student population paying to attend public school in the greater Vancouver area. Schools and school boards in general are just trying to ensure that students who are eligible to attend public school without paying can do so and those who do have to pay do pay. The fact that there is a teacher shortage is another reasons many schools are trying to ensure that that only those entitled attend school.

So Government of BC provides funding to all 60 District Boards in BC, and set minimum enrollment criteria to avoid each SD set their own. Simply overcoming Variability. My 8th grade daughter went to 3 different SBs since moving to BC, and before she became permanent resident. One parent proof of status and birth certificate to prove relationship was required all those time and never being asked of her status. The only hassle is we were supposed to reapply each year for funding but stopped after she became a permanent resident. She moved to Canada with Type 10 Visitors Record. Never had study permit

Was this in the past few years? The changes started around covid time.
