Apply for FSW and live in Quebec

Hello everyone

I apologize if there are other threads with the same information. I would appreciate if you can point them out.

Some background information. My spouse and I (common-law) have recently graduated from a Canadian University in Ontario. I have work experience from the US and I am planning to use it to apply for federal skilled worker (FSW) express entry. I am waiting for the certificate from my University to apply as soon as possible as I have collected all the other documents (English, police certificates, etc). She has received a job offer from an employer in Montreal and we would like to live there. She has lived in Canada for the past 10 years with a bachelor and PhD from Canadian universities. However, none of us speak French.

If I apply now for the FSW I should receive an invitation for PR in December/January. Her job starts in mid-January. Now, if we move into Montreal, I would be "residing" in Quebec which I believe has a different express entry program (CSQ). The FSW states the "intent to reside" anywhere in Canada but Quebec as they have their own express entry streams.

My questions are:

1) If I start the express entry in Ontario but then I move, do I need to update it and thus change my "intent to reside"?

1a) If so, Does that mean I can no longer apply for the FSW?

2) If 1a means I cannot apply, can I live in Ontario and commute/work to Montreal? Has anybody done it before?

If you are applying under Express Entry, mention intent to reside in Ontario.

Once you get PR, complete your PR formalities at Toronto Airport and then you can go to Quebec.

The best way to go about this is to have nothing to do with Quebec until you get your CoPR. At that point, you have right of abode in Canada and can live and work anywhere in the country.

You could apply for FSW living in Quebec, but they'd probably reject it, since you moved specifically from Ontario to Quebec. My feeling is that IRCC is very suspicious of people having ties to Quebec when doing Express Entry, because it's their only opportunity to enforce the rule.

Of course, in practice, if you moved to Quebec but kept a mailing address in Ontario and didn't update with IRCC, who knows if they'd figure it out.

I'm a FSW through EE. I have good reasons to stay in Quebec if needs be (family), and in my application I stated that I intend to reside in Quebec at some point. Is that a mistake that might cause refusal? I also submitted a web form to explain my case and that I won't reside in Quebec ultimately.

You shouldn't have said that you want to stay in Quebec. Once you are a PR, charter rights allow you to move to Quebec iirc. But, stating that on your application will cause issues. You need to figure out how you'll convince an officer that you intend to settle outside of Quebec.

Do you think that IRCC will contact me after I submitted my webform or they'll reject my application right away?

Thanks for the above! I am worried IRCC won't leave room for explanation/contact and directly refuse my application. I don't want my webform to be disregarded. What do you think might happen?

I'd highly suggest that you research the forum and understand what happened in the past cases to get a better picture. You can additionally talk to a Canadian immigration lawyer to get the best idea.
