Advice on Inland Family Sponsorship (Spouse) and Open Work Permit

Hello, I have been sponsoring my wife for Permanent Residency through an Inland Sponsorship, and paid for an OWP at the same time. She had a Visitor's Record that expired about 60 days ago. (I recently discovered the mistake I made assuming that she would have "maintained status" while waiting for PR like she did while waiting for a Visitor Record application)

We have received her AOR about a month ago. On the tracker website it states that her "eligibility" and "bio-metrics" are completed, and that her "medical exam" and "background check" are in progress and still being reviewed. We've already submitted the medical exam.

Unfortunately, I have been getting confused in researching for her Open Work Permit application. According to the Canada website, even without valid status, we just need to wait for an "Approval in Principle letter" but we're not sure when we'll receive it.

Also, I have seen resources for "Restoration of Status." If we apply for that or just a new visitor's record altogether. Then, if I understand correctly, she would be able to apply for a work permit before her AIP letter.

We want to make sure that we're doing things correctly, and I don't want to make any more mistakes. If we still are required to wait for her AIP before a OWP, should we still re-establish her status as a temporary visitor?

If there's any confusion in my explanation let me know, thank you very much for reading and we appreciate any help on the issue.

She is out of status. So yes, you would need to wait for AIP before she can apply for the OWP. Yes, strongly recommended that she apply to restore her status.

Alright we'll absolutely get to restoring her status. Thank you very much for the help. Disappointing that we'll need to wait until after her AIP, but it's nice getting a solid answer.

I belive that if status restoration is successful, they don't need to wait for AIP.

Yes, that's right. I should have made my post clearer. As things stand now, the spouse does not qualify for an OWP with AOR since she is out of status in Canada. If they apply for restoration and restoration is approved, she can then apply for the OWP with AOR.

Im almost in this category, although after applying for inland sponsorship I also applied for open work permit without aor, so wen I got the aor I raised a web form and submitted the aor with my open work permit, haven’t heard from ircc my status expires on 30 sept I don’t even know if I’m on maintained status

Apply to extend your visitor status tomorrow. That way you have insurance in case IRCC doesn't match up the OWP with the AOR and refuses the OWP.
